A case that I worked on since last year involving the abduction of a child by his father has been reported both as a fact finding judgment and a welfare decision earlier this year. I represented the child and the Court made serious findings against the father, including editing/falsifying evidence that he presented to the Court. The case illustrates that abducting a child is not only a criminal offence but also extremely harmful to the child who is deprived of a relationship with the other parent. Arbitration is an alternative route available to parents who have a problem reaching their own agreements for their children but do not want to get caught up in the delays in the Family Court system that can take years to resolve. Arbitration is an alternative dispute resolution model that is quick, binding and confidential and enables parents to move on quickly once a decision (called a determination) is made.
Arbitration is available to families where there are no safeguarding issues and both parents consent to arbitrate. The arbitrator can resolve the full spectrum of disputes between separated parents but it is particularly effective in relation to discrete issues such as a change of school that offend needs a quick resolution due to application deadlines.
