Back-to-school reminder for separated parents: know your rights 🎒

If you have Parental Responsibility:
1. You can contact your child’s school directly for appropriate information about your child. 🏫
2. You can remain involved in your child’s education. 📚
3. Important decisions about your child should be approached with the other person with PR in mind 🤝
4. A major change such as changing your child’s school should generally be discussed and agreed where both parents have PR. 🏫
5. If you cannot agree, legal advice may help you understand your options. ⚖️

Can a parent with Parental Responsibility contact their child’s school?🏫

Generally, yes.

If you have Parental Responsibility, you can contact the school and ask for information about your child, including relevant updates about their education.

You don’t necessarily need the other parent to act as the go-between.

As the new school year begins, make sure you know what information you are entitled to receive and how you can stay involved in your child’s education.

Every parent with PR should have the opportunity to remain appropriately involved in their child’s school life 🎒

Your child is due to start school for the first time.

One parent wants School A.

The other wants School B.

So what happens?

Where parents with parental responsibility cannot agree about an important aspect of their child’s education, the disagreement may need to be resolved formally.

In some circumstances, an application for a Specific Issue Order can be made asking the Family Court to decide the particular issue.

The court will consider what is in the child’s best interests, taking into account the circumstances of the individual child and family.

⚠️ A school application can have practical consequences for much more than education — including travel, contact arrangements, childcare and the child’s wider routine.

If agreement cannot be reached, getting advice early may be better than waiting until a deadline is looming.

A little reminder to parents as those lovely “back to school” photos start appearing on social media…

📸 Please think carefully about what is visible in the background before posting.

For your child’s own safety and privacy, try to avoid showing:
🏫 The name or logo of their school
👕 School uniforms or badges
📍 The school building or identifiable location
🪪 Name labels or other personal information

We know how exciting the first day back can be, and sharing those special moments is completely understandable.

Just take an extra few seconds to check the photo before posting — once it’s online, you have very little control over where it ends up.

Can one parent simply move your child to another school?🏫

Changing a child’s school can be a significant decision.

Where both parents have Parental Responsibility, the decision should generally be discussed and agreed between them. If an agreement cannot be reached, there may be legal options available, including asking the court to decide the issue.

This can become particularly important when a proposed school change would affect:
📍 Where your child lives�🚗 Travel arrangements�👨‍👩‍👧 Time spent with the other parent�📚 Your child’s education and routine

It’s that time of year when school applications, offers and decisions are on many parents’ minds.

But what happens when separated parents can’t agree which school their child should attend?

Where both parents have parental responsibility, decisions about a child’s education can sometimes require agreement between them.

This can become particularly important when a child is:

📚 Starting their first school
🏫 Moving to a new school
🎓 Starting secondary/high school
📍 Moving to a school in a different area
👨‍👩‍👧‍👦 Applying to schools where parents have different preferences

If parents cannot reach agreement, the court may be able to determine the issue through a Specific Issue Order.

The court’s focus is the child’s welfare and best interests, rather than which parent “wins”.

If you are already struggling to agree, don’t leave it until the application deadline is approaching.

Early advice can help parents understand their options and avoid unnecessary conflict.

If you have Parental Responsibility (PR) for your child, you have an important role in decisions about their upbringing and education.

Major decisions about your child should not simply be made by one parent without considering the other parent’s rights and responsibilities.

If you have PR, you can also contact your child’s school directly and ask for information and updates about their education, progress and wellbeing.

Being separated doesn’t mean being separated from your child’s school life. 📚
