Can a beneficiary also be an Executor of a Will?

This is one of those questions where people are often surprised by the answer. Yes, they can.

In fact, it's very common for someone named as an Executor to also be a beneficiary of the same Will.

An Executor is the person responsible for dealing with the estate and carrying out the instructions in the Will.

A beneficiary is someone who is entitled to receive something from the estate.

So, for example, you might appoint your adult son or daughter as an Executor while also leaving part of your estate to them. The two roles don't have to be completely separate.

What matters when choosing your Executors is thinking carefully about who you trust to take on the responsibility. Estate administration can involve dealing with financial institutions, property, debts, tax matters and ultimately distributing the estate according to the Will.

You can also appoint more than one Executor, which can sometimes help to share the responsibility.

Every family's circumstances are different, so choosing the right people is something we can talk through when preparing your Will.

And remember, an Executor can be a beneficiary, but a beneficiary should not witness your Will, as this can affect their entitlement under it.

Bank Holiday Weekend... time to get things in order?

A long weekend often gives us a little breathing space from the usual routine.

And while I'm certainly not suggesting you spend your entire Bank Holiday thinking about legal paperwork, it could be a good opportunity to finally tackle one of those jobs that's been sitting on the "I'll do it eventually" list.

→ When did you last look at your Will?
→ Have your circumstances changed since you wrote it?
→ Have you been meaning to put a Lasting Power of Attorney in place?
→ Or perhaps you've been saying for months that you really should make a Will in the first place?

You don't need to sort everything this weekend. Sometimes simply deciding "I'm going to get this done" is the first step.

"Of course I'll be your Executor."

It's an easy thing to say when someone you care about asks you.

Being chosen as an Executor can feel like an honour. It means somebody trusts you to deal with their affairs and carry out their wishes after they've died.

But do you know what you've actually agreed to?

It can be a significant responsibility, particularly when you're also dealing with the loss of someone you love.

So, if somebody asks you to be their Executor, don't be afraid to have a conversation.

Making a Will is just writing down who gets what... isn't it? Not quite.

When I sit down with somebody to discuss their Will, I'm not simply filling in names on a document.

There are lots of things we may need to talk about.

→ Who would you trust to act as your Executors?
→ If you have young children, who would you want to appoint as their guardians?
→ Are there particular possessions or sums of money you'd like to leave to someone?
→ What property and other assets do you own?
→ Are there any previous relationships, children from different relationships or other family circumstances we need to consider?
→ Who should inherit what's left after any specific gifts have been made?

Most importantly... What do YOU actually want to happen?

These conversations allow me to understand the bigger picture before preparing a Will that reflects your circumstances and wishes.

That's one of the reasons I believe there's real value in sitting down with a specialist rather than simply filling in a template online.

It's a question that can come with a lot of emotion behind it.

It's National Financial Awareness Day! 🧠

How well do you know your own financial affairs?

Most of us know roughly what's in our bank account and what comes out each month. But what about the bigger picture?

Do you know where all of your important financial documents are kept?

Does your Will still reflect your current circumstances?

Would your family know about your accounts, pensions, property and other assets if they needed to?

Financial awareness isn't only about what you earn, spend or save.

It's also about being organised and making sure the people you love aren't left trying to piece everything together at an already difficult time.

So, for National Financial Awareness Day, perhaps take 10 minutes to think about the bigger picture.

You don't need to have everything perfectly organised today. Simply knowing what you have, where the important information is and whether your Will is up to date is a very good place to start.

Sometimes it's the smallest jobs that make the biggest difference.

You don't need to spend hours getting organised today. Just take five minutes.

Ask yourself:
✔ Does someone know where my Will is kept?
✔ Are my important documents together?
✔ Would my family know who to contact if they needed help?
✔ Have I told my Executors that I've chosen them?

These simple steps don't cost anything, but they can make life much easier for the people you love when they need it most.

Estate planning isn't always about big decisions.

Sometimes, it's about making the practical things just a little simpler.
