What is a Consent Order? ✍️

If you and your ex spouse have agreed how your finances will be dealt with following separation or divorce, a Consent Order can make that agreement legally binding.

It can set out what happens to:
🏠 The family home
💰 Savings and investments
💳 Debts
💷 Pensions
📄 Other financial assets

Even if you have reached an agreement amicably, it’s important to get the agreement properly documented and approved by the Court.

An agreement between you and your ex spouse isn’t legally binding until a Consent Order has been approved by the court.

What is Parental Responsibility?

There’s often confusion about what it actually means.

Parental Responsibility isn’t about who your child lives with or how much time they spend with each parent. It’s the legal rights, duties and responsibilities you have in relation to your child.

If you have Parental Responsibility, you’ll usually have the right to be involved in important decisions about your child’s life, including:

* Where they go to school.
* Significant medical treatment.
* Their religion and upbringing.
* Changing their name.
* Applying for a passport.
* Taking them to live abroad.

⚖️At What Age can a child choose to live with one parent after divorce or separation?

In England and Wales, there is no set age at which a child can legally choose which parent they want to live with following separation or divorce. If parents can not agree on living arrangements, the court will make a decision based on what is in the child's best interests.

As a child gets older and demonstrates greater maturity, their wishes and feelings will be taken in to consideration, particularly those aged 10 or over. The child's welfare will be the court's paramount concern.

Where possible, parents are encouraged to work together to reach arrangements to try and avoid the need for court proceedings.

👵👴 Do grandparents have a legal right to see their grandchildren?

It’s a question I’m asked time and time again.

The simple answer is, not automatically.

Unlike parents, grandparents don’t have an automatic legal right to spend time with their grandchildren. However, that doesn’t mean they can’t apply to the court if contact has broken down.

Before making an application, the court will usually encourage families to explore whether the issue can be resolved through discussion or mediation.

If the matter does come before the court, the child’s welfare will always be the court’s top priority.

Every family is different, and every situation deserves careful consideration.
