Success by negotiation at Tribunal. Negotiations in SS Law is controversial. No provision equivalent to Part 36 of CPR or settlement agreements of ERA. Also Reg 52 lapse, is often subject to abuse of process, with appeal rights fettered.

Therefore if negotiations/offer is given by SOS, safer route is to have negotiations judicially supervised, with the outcome decision given by judicial disposal. This will protect from abuse of process. The use of TPR Rule 32 Consent Orders, could have a wider application.
