“He’s gone now, sir.”

Gregory Peck’s Robert Thorn reiterates a reasonable instruction to Billie Whitelaw’s Mrs. Baylock to remove a seemingly stray dog from his home, only for her to disobey that instruction (as we later discover) in The Omen (1976) 👦🏻🐕‍🦺📷👵🚲🗡️. Where an employee repeatedly refuses to follow their employer’s instructions, whether this is misconduct, gross misconduct, or not hinges on whether the instructions they are being given are reasonable in the first place.

🌊💡 On Monday afternoon, Caroline Watkins of Harbourlight HR and I caught up for a lovely get-to-know-you chat, including discussing the ongoing changes to employment law.

☀️🖥️ On Tuesday morning, Ezana T. Haddis of Aria Grace Law CIC and I had a great chat about overseas travel, business development, and how to help consultant lawyers to succeed.

At my desk, I’ve advised a law firm on refining contractual arrangements with an employee ✍️ and calculating holiday entitlement 🧮, advised an HR professional on issues surrounding the national minimum wage 💷, advised an employee on a redundancy consultation process 🔄, advised an employee on whether they should really be signing a settlement agreement 💬, advised an employee on their settlement agreement 📑, advised an employee on a revision to a settlement agreement that’s already been signed ✍️, completed routine Internet security training 🔒, completed negotiations on two settlement agreements ✅✅, prepared a first draft of my LinkedIn newsletter for August 📰, and had three settlement agreements fall through where my employee clients have not wanted to proceed (which is a shame, but has felt like the best thing for the employees) 🙂‍↔️🙂‍↔️🙂‍↔️.

Putting the more outlandish events of The Omen to one side, why could Mrs. Baylock’s behaviour be unreasonable?

How Much Notice Do You Have to Give to Your Employer to End Your Employment? ⏰

This hinges on whether you have a contract of employment or not.

If you do have a contract of employment, take a very good look at what it says in terms of leaving your employment (which is often referred to as “termination”) 🔎, as that cannot fall below the statutory minimum notice, but can require you to give more notice.

If you don’t have a contract of employment, there are statutory minimum and implied notice periods for you to give to your employer in certain circumstances, as we explore here… 🔎

Many employees who I meet are often eager to sign the settlement agreement that they’ve been offered by their employer ✍️ when they come to see me.

Often, going to see a solicitor in those circumstances is seen as an annoyance 🙄, even though it’s actually a legal safeguard 🛡️ to make sure that everything is being done properly and so that they have someone in their corner to help them.

Someone who is there purely for them and not for their employer.

When I see employees in that sort of situation, I aim to put myself in their shoes 👞.

Would I want a professional to talk to me using jargon? 💬

No, I’d want them to know what they’re doing, but to be able to communicate the impact on me clearly in terms that I can understand.

Would I want a professional to listen to me? 👂

Yes.

Would I want someone the breeze through as if I’m a number on a spreadsheet or to take their time? 🕰️

I’d prefer them to take their time.

“What Does ‘Non-Exclusive Jurisdiction’ Mean in My Employment-Related Settlement Agreement?”

Last week, we talked about the courts 👨‍⚖️ of one country being the sole place where you or your employer could bring claims relating to your settlement agreement and how it applies on a day-to-day basis if your settlement agreement allows that (a.k.a. ‘exclusive jurisdiction).

That is a massive clue 🔎 for what ‘non-exclusive jurisdiction’ means, but don’t mistake it for simply being the opposite of exclusive jurisdiction, because it is much more than that.

Michel Legrand’s score 💿 to the rogue James Bond 🤵‍♂️ film, Never Say Never Again (1983) 👩🏻🤿🏝️🦈🕹️🏍️ returns for week 109 of the work playlist 📱, specifically 🤿 Track 25: “Fight to the Death”.

Other than its opening, this track is very different to what is heard in the film, focusing less on the film’s main action theme.

Shocked trumpets scream out as Maximilian Largo (Klaus Maria Brandauer) and his underwater sled carrying a stolen nuclear warhead suddenly bear down on James Bond (Sir Sean Connery), whilst electric guitars and tapped hi-hats create a sense of urgency as the warhead counts down to destroy a huge Middle Eastern oil field.

Grim horns rise into screaming trumpets to accompany 007 and Largo engaging in underwater combat. The instruments rise and fall until subsiding into tapped hi-hats as Bond tears Largo’s face mask off in a nice nod to Thunderball (1965) 💣🛥️🤿👩🏻‍🦰🏝️🦈.

The deeper horns follow 007 as he pursues the runaway underwater sled, jamming one of its propellers to brash trumpets so that it drifts aimlessly. However, the trumpets become laboured as Largo catches up to him, knife in hand.

The deeper horns and dramatic trumpets take up the sense of time urgency and danger as Bond faces off against Largo, things taking a downward plunge as Largo drops his knife.

Deep and high horns play off of each other as the two men continue to struggle, the high horns becoming almost triumphant against stroked hi-hats as the underwater sled suddenly bears down on them, trapping Largo.

Light drums, tambourine, and frantic piano represent the sled’s remaining propeller kicking up sand and 007 trying to disarm the warhead. Deeper drums, subtle low horns, and trumpets hint at the film’s main action theme before a shrill, warning pipe screams out, trying to warn Bond that Largo has a speargun trained on him.

Rumbling timpani and subtle trumpets hint at the film’s main action theme again, the trumpets launching forward just as a spear is launched forward…but at whom?

Is it time for a new Bond film to be set mainly underwater 🤿 again?

Inde Navarrette’s Nikki Freeman screams at Michael Johnston’s Baron “Bear” Bailey, forcing him to stay with her in Obsession (2025) 👨🐈👩🏻👤😱🧱. Although an employee cannot be forced to work their notice period by their employer, it is a breach of contract for them not to work it and the employer could choose to sue them for the financial losses caused by the employee not working their notice period.

Just Using the Same Restrictive Covenants for All Your Employees Isn’t a Pathway to Success… ❌🛣️❌

…in fact, it increases the risk that those restrictive covenants are less enforceable where you actually do need them to apply.

A court will want to see that you have put serious, practical thought 🤔 into your restrictive covenants in your employment contracts.

The more that you can justify them logically 💡, the more enforceable they are likely to be ⛓️.

For instance, if Jerry, a junior salesperson with little or no influence with your customers or clients has the same restrictive covenants as Jane, their team leader, who is much more likely to have a client following, there’s clearly some significant imbalance there 🤷🏽🤷‍♀️🤷🏻‍♂️.

Worse, if the restrictive covenants aren’t enforceable against Jerry, that might water down their effectiveness against Jane, leaving you open to attack ⚔️.

So how can you address this whilst still protecting your business? 🛡️
