Mutual Wills form a contract between two people which becomes legally binding following the first death. They normally pass assets to each other and to a third party on second death. Thus the survivor cannot change their Will. However, life is full of eventualities and it is not always possible to preserve assets this way. There are much more effective ways of protecting assets and beneficiaries, such as trusts. My advice is to check your Will to ensure it is a suitable document and change it if it is not. Wills for married couples made before October 2007 normally included a discretionary trust to allow the surviving spouse to benefit from the deceased spouse's estate while utilising the inheritance tax allowance called the nil rate band. Legislation introduced since that date allows for this allowance to be transferred between spouses so those trusts may not longer be required.
It is important to check the date and contents of your will and update it if necessary.
