If you have children under the age of 18, it's a worry what will happen to them if you're no longer around

Who cares about them as you do? Who can raise them in the same loving manner? Who can be there for every scraped knee and every broken heart?

When you know the answers to these questions, you'll know who you want to name as Guardian for your children should the worst happen to you

If you need to name a Guardian for your children, contact me today for free, no-obligation advice

I keep saying it's important to have a Will in place, but what exactly is it?

πŸ“œ It's a legal document

☝️ It gives instructions about what happens to your belongings when you pass away

πŸ‘ͺ It can name who you want to look after your children before they reach adulthood

βœ’οΈ It names the person responsible for carrying out your wishes (called an executor)

If you need to have a Will written and you're unsure what to do or where to go, contact me today for free, no-obligation advice

Do I have to make a new Will every time I want to change something?

Not necessarily...

For small changes, you can use a Codicil

Codicils still need to be signed and witnessed in the same way as a Will, but they mean you don't need to have a new Will written every time there's a small change in your life

However, if the change is complex, or you find you've used multiple codicils and your Will is now complicated to follow, it's best to have a new one written

If you're unsure about whether you can use a codicil, or if you need an entirely new Will, contact me today for free, no-obligation advice

There are three legal reasons why your Will may not be valid:

1. If it's unsigned by yourself or two witnesses

2. You didn't understand what was being written or that it was a legal document due to a lack of mental capacity

3. You were pressured into writing your Will or including certain gifts within it

If your Will is not valid, you will be classed as intestate when you pass away and the Rules of Intestacy will apply to your Estate

Or, if your famiily believe any of these apply after you pass away, they may challenge the Will in court which can lead to the Will being overturned

If you think any of these may apply to your Will, contact me today for free, no-obligation advice on what to do next

A change in the weather can lead us to yearn for better times

Times when we could be together with our loved ones, enjoying the sun and going for walks on the beach with ice cream dripping down our hands

Ensuring our loved ones are able to keep making memories once we're no longer around can help give peace of mind as we move through life

Having a well-thought-out Will in place can ensure our loved ones are taken care of and able to remember us even though we're no longer here with them

LPAs don't have an expiry date, so don't exipre in the traditional sense

However, they can become invalid through specific legal events:

πŸ“œ The person the LPA is for has passed away

πŸ“œ The Attorney passes away, or loses mental capacity, with no replacement named

πŸ“œ The person who made the LPA has cancelled it

πŸ“œ The Attorney for property and financial affairs has become bankrupt

πŸ“œ The Court of Protection has stepped in and cancelled the LPA

If you have an existing LPA and you want to ensure it's up to date and still valid, contact me today and let's ensure you're protected when the time comes
