Why a Will Is More Than Just a Document

You may have heard that a will can be created in minutes — even generated by AI or prepared quickly as part of a standard legal service.

But the document itself is only a small part of the process.

Because the reality is, many of the risks in estate planning aren’t obvious.

Recently in a client meeting I was asked the following: ‘I get why I should have an LPA for Property and Financial affairs, but I am not clear why I should also have the one for Health & Welfare?’

Well, here is my take on the value of a Health & Welfare LPA

“A Health & Welfare Lasting Power of Attorney is about control, certainty, and protecting your voice when you can no longer communicate it yourself.”

In practical terms, its value comes down to three key areas:

1. Control over your care and medical decisions

A Health & Welfare LPA allows you to legally appoint someone you trust to make decisions about your care, treatment, and living arrangements if you lose mental capacity.
That includes:
• Medical treatment (including consenting to or refusing treatment)
• Where you live (e.g. remaining at home vs. moving into care)
• Day-to-day care and wellbeing (food, routine, personal care)
➡️ Without it, these decisions default to doctors or social services, not your family.

2. Ensuring your wishes are respected

It’s not just about who makes decisions — it’s about how those decisions are made.
• You can document preferences and instructions (e.g. care at home, specific treatments)
• Your attorney is legally required to act in your best interests under the Mental Capacity Act 2005
• It gives someone the ability to advocate for you in real-time situations, not just follow a static document
➡️ In short, it ensures your values and beliefs guide decisions, even when you cannot express them.

3. Reducing stress, delay, and conflict for loved ones

A major part of the value is what it avoids:
• Family members do not automatically have legal authority without an LPA

Time, memories… and passing the baton

Earlier this month, an old friend came to stay for an extended weekend.

We hadn’t spent proper time together for some time — the kind of weekend where conversation picks up exactly where it left off, even though so much of life has happened in between.

It was a reminder of how quickly time moves.
Not long after, I received an invitation to celebrate the 50th anniversary of my old school — in Hertfordshire — and it stopped me in my tracks. I was there in that founding year. It doesn’t feel like 50 years ago… but of course, it is.

Between those two moments, it really struck me:

Life quietly gathers pace.
Families grow.
Children become adults.
Some people we love are no longer here.
And yet, the memories… those stay with us.

At a certain point, many of us begin to think differently about what we leave behind — not just financially, but in terms of clarity, guidance, and care for the people who matter most.

In many ways, it’s about passing the baton.
Making sure the next generation is supported.
Making things easier during what can be a difficult time.
And ensuring that what you’ve built — in whatever form that takes — is handled in the way you would want.

It’s not always the easiest conversation to start, but it is one of the most important.
