Untangle the wrangle! The law relating to how finances are divided upon divorce, the Matrimonial Causes Act 1973, is over 50 years old. Notable cases decided interpret how that law applies in practice. Reading it gives no indication of an outcome of the financial settlement . We no longer have to "petition" for divorce in court. Under the 2022 no fault divorce either party or both jointly can quite easily make an application online for a divorce order. But this does not deal with the financial matters between the parties, such as the house, savings and pensions. These survive divorce, and remarriage before the finances are settled and concluded in a court order can have a devastating effect and even bar a party from bringing financial claims except against the other's pension.
