Pension reform 2027 (Inheritance Tax) – when I speak with potential clients they seem largely unaware that from 6th April 2027 unused pensions will no longer be exempt from inheritance tax, and will form part of the estate as with most other assets. They certainly seem completely unaware of the double taxation risk, whereby if the pension holder dies after the age of 75 the beneficiary faces 40% inheritance tax PLUS income tax on the income received from the pension withdrawals. Finally, for large estates the residence nil rate band (RNRB) is also lost. Are you and your family affected?

How to structure the Will to protect the prime residence - this is achieved by severing the tenancy from 'joint tenants' to 'tenants in common' and implementing a trust within the Will. Upon first passing their half of the house enters the family trust, and is held in trust for the beneficiaries, preventing from sideways disinheritance, controlling the long term care conversation, etc. A simple but effective approach to manage and protect family assets. ARE YOU MARRIED WITH CHILDREN? This is why you MUST have a Will, without one spouses only automatically inherit the first £322k. This can cause huge issues especially if the children are under the age of 18 i.e. the monies enter a trust. IF YOU ARE UNMARRIED YOUR CHILDREN INHERIT EVERYTHING IN EQUAL SHARES!!
