Is a small legal snag holding up your sale?

It happens more often than you'd think. A missing document, an old bit of building work that was never signed off, a freeholder nobody can quite track down, and suddenly your transaction's stuck.

Property Indemnity Insurance can sometimes be the answer. It's usually a one-off policy that protects a buyer or their mortgage lender against financial loss if one of these legal defects ever causes a problem down the line.

It won't fix everything. Some issues genuinely need sorting at the source rather than insured around, and knowing which is which comes down to the specifics of your case. That's the bit our conveyancing team spends time getting right, working out whether indemnity insurance is a sensible option for your property or whether something else makes more sense.

Your offer's been accepted.

That's a genuinely good moment, but it isn't the finish line yet. There's a fair bit happening behind the scenes before your purchase becomes legally binding, and it helps to know roughly what that looks like.

Your conveyancer gets going on the contract pack and the property searches. Your mortgage lender runs its own checks and arranges a valuation. If you've opted for a survey, that gets booked in too, so anything worth knowing about the property comes to light before you commit further. Meanwhile, enquiries go out to the seller's solicitor to clear up anything that needs a closer look.

Having someone experienced guiding you through each part means you're not left guessing what's happening or why, at a point when it can feel like a lot to take in.

Contracts only become legally binding once they've been exchanged, so everything before that is really about getting the details right rather than rushing ahead.

One question we hear regularly is, "Can I exchange contracts while I'm away?"
The only thing we ask is that you stay contactable, as we do need your final instructions before exchange goes through.

As long as your solicitor has your signed paperwork and you've given authority to proceed, your transaction can still move forward while you're away. Exchange doesn't stop for anyone's holiday.

Planning ahead helps keep everything on track. If you've got a holiday booked around your move, let your conveyancer know as early as possible so we can plan around it together.

Thinking of buying a property with someone else?
A Declaration of Trust can give everyone peace of mind from the very beginning.

This legal agreement sets out exactly how much each owner is entitled to if the property is ever sold. It's especially useful when unmarried couples, and in some cases married couples, buy together and put in different amounts towards the purchase price.

Say one of you puts down a bigger deposit, or pays more towards the mortgage each month. Without something agreed in writing, working out who gets what later can turn into a difficult conversation at exactly the wrong time.

Having everything set down early helps avoid misunderstandings and protects everyone's financial interests, whatever happens to the relationship or the property down the line.
