On Friday the 15th of August at 11am-1pm we are hosting an online 2 hour surgery/seminar for parents/carers of children and adults with additional needs, to cover the areas of SEN/Education and Health Care Trust obligations to provide Respite/day opportunities.

It is for people who have a legal query regarding these areas.

It will be free to join and anyone with a query is welcome to attend it and ask questions. We also have a free guidance document that covers these areas if you would like a copy.

Our Office are presently undergoing strategic research in relation to the issue of disability discrimination for SEN children in school and indeed non educational discrimination, for example in relation to services that are provided, or ought to be provided, by a Health Care Trust. It is an area of law in NI that is ripe for development.

In respect of education, claims can be brought against Schools, or indeed the EA, for less favourable treatment or failure to make reasonable adjustments for a disabled pupil.

There is a 6 month time limit from when the discrimination occurred to lodge the claim. Examples can include school exclusion, suspension or expulsion, reduced hours, failure to secure a placement by the EA, refusal to permit attendance at school trips etc. There are other circumstances that can give rise to a claim. If you are not sure just ask us.

We are interested in hearing from anyone who feels that their disabled child, or indeed adult, has been the subject of disability discrimination either in their education or from a public authority.

We plan to release guidance for parents/carers soon to help navigate what is a complex area of law.
