Applicants who cannot meet the Financial Requirements under Appendix FM (Family Visa) may still be eligible to come into or remain in the UK

Applicants for entry clearance or limited leave to remain as a partner under the 5- year route are generally required to demonstrate that they meet the minimum income requirement under Appendix FM. However, in some cases, applicants will be permitted to demonstrate that they meet the minimum income requirement with reference to other credible and reliable sources of income, financial support or funds. These are cases where it could be demonstrated that the refusal of the application could result in unjustifiably harsh consequences for the applicant, their partner or a relevant child. This is a high threshold.

The Home Office must consider all the circumstances relating to the applicant and their family, based on the information and evidence provided by the applicant.

Therefore, it is imperative that strong and compelling information and evidence is provided and relevant factors for each individual case is taken into account.

Family life does exist with parents!! the Court in the case of Mobeen v Secretary of State for the Home Department [2021] EWCA Civ 886 (14 June 2021) https://www.bailii.org/ew/cases/EWCA/Civ/2021/886.html stated ‘Normal emotional ties will not usually be enough; further elements of emotional and/or financial dependency are necessary, albeit that there is no requirement to prove exceptional dependency…The extent and nature of any support from other family members will be relevant, as will the existence of any relevant cultural or social traditions. Indeed, in a case where the focus is on the parent, the issue is the extent of the dependency of the older relative on the younger ones in the UK and whether or not that dependency creates something more than the normal emotional ties… The ultimate question has been described as being whether or not this is a case of "effective, real or committed support" …... or whether there is "the real existence in practice of close personal ties"
Therefore, strong, and compelling evidence such as appropriate expert reports are imperative in these types of cases. Each case is decided on its merit and making a strong application from the outset is crucial.
