Yacht purchase: have you been asked to provide a consultancy letter ?

When acquiring a yacht through a bank loan, financial institutions frequently require the buyer to contract an expert to obtain a consultancy letter on the purchase and its fiscal implications.
It could, for example, be to ascertain that the delivery protocol will not trigger a VAT payment or to determine whether or not the buyer will comply with the criteria allowing free circulation in the European Union.

YMCA RECOMMEND THE IMPORTATION UNDER THE REVERSE CHARGE MECHANISM

Importation under the French reverse charge mechanism allows the VAT to be "accounted for". The VAT is declared and claimed back on the same monthly VAT return. This process involves no actual payment, serving as a straightforward accounting operation of immediate payment and deduction.
The importation procedure is relatively simple and conducted remotely with minimal documentation required. The key requirements are that the owning company must have an active VAT number in France, and the yacht must be located in French waters.

It is also mandatory to carry out real commercial activity to benefit from this mechanism.

A QUICKER IMPORTATION IN FRANCE IF YOU ALREADY HAVE A FRENCH VAT NUMBER !

Since January 1st, 2022, it is necessary to obtain a French VAT number before carrying out an importation in France. The commercial importation in France allows a VAT exemption upon importation.

The good news is that owning companies who already have a French VAT number do not need to request a new one.
Therefore, if you already have a French VAT number, the importation will be much quicker than in the past. There are no more authorizations to request which sometimes caused delays that could prevent a fast importation in France.

CHASE BOATS AND TENDERS WITH THEIR OWN REGISTRATION – WHAT NEEDS TO BE DONE ?

Non-EU tenders or chase boats sailing with their own registration and accompanying a main commercial vessel are considered, from a Customs point of view, under temporary admission, providing that the criteria are met (non-EU registry, owning company and UBO).
As a result, EU residents are not permitted to use this tender unless the following conditions are fulfilled:
The main vessel has been officially imported into the European Union.
The tender is explicitly mentioned in all charter contracts.
The tender is used exclusively in connection with the main vessel.
Its usage is limited to specific activities such as transporting passengers to shore or navigating areas that are otherwise inaccessible.

A verbal declaration for the tender must be submitted after importing the main vessel.

Sanction your temporary admission status with a verbal declaration document!

As you may know, some non-EU flag yachts can benefit from the temporary admission relief (TAR) in the EU waters up to 18 months in a row if they are owned by a non-EU company and used by an ultimate beneficial owner resident outside the European Union.
It is possible (albeit optional) to officialize the TAR status through a verbal declaration document (71-01). This document can be very useful as it states the starting point of the 18 month time-delay. Additionally, some EU countries have a very narrow interpretation of the Union customs code and still believe that the TAR must mandatorily be sanctioned by a verbal declaration document.
In France, we would advise to carry out this procedure preferably in the Cannes area, Marseille or Port Vendres.
