- ANNOUNCEMENT -
On 5 June 2024, Simon Deceuninck of Citizen Avocats (Bordeaux) and Paul Zieltjens of OTIS Advocaten (Amsterdam) obtained a favourable judgment from the Amsterdam District Court, whereby a holding company domiciled in the Netherlands is ordered to compensate their client, an executive of English nationality working from Nigeria, for the unlawful termination of a contract governed by French law.
As a result of their effective teamwork, the two counsels secured recognition of their client's right to compensation of US$141,954.

Maître Simon Deceuninck, du Cabinet Citizen Avocats (Bordeaux) et Maître Paul Zieltjens, du Cabinet OTIS Advocaten (Amsterdam) ont obtenu, ce 5 juin 2024, la condamnation, par le Tribunal de District d'Amsterdam, d’une société holding domiciliée aux Pays-Bas à indemniser leur client, cadre exécutif du groupe, de nationalité anglaise et exerçant ses missions depuis le Nigeria, au titre d’un contrat soumis au droit français.
Au terme d’un travail d’équipe efficace, les deux Conseils ont fait reconnaître le droit de leur client lésé à être indemnisé à hauteur de 141.954 US$.

We are happy to share the article written by Simon Deceuninck, partner at Citizen Avocats, as part of our collaboration with the Club de l'Arbitrage. This article is the first in a cross-disciplinary series on the subject of third-party funding of international arbitration. The author discusses the strategic and ethical issues of third-party funding during the pre-contractual phase, i.e. before the contract is signed between the litigant and the financier.

The author presents the subjective viewpoint of a French lawyer, concerning the phase prior to the signing of a contract for third-party funding of international arbitration proceedings.

A Letter of Intent (LOI) is a document, written in the form of a letter or declaration, whereby its author informs the addressee of his genuine intention to enter into or continue negotiations with him. The LOI therefore formalises a willingness to enter into talks and aims to establish a relationship of trust and professionalism between the parties (generally the seller and the buyer). Above all, this document makes it possible to sketch out the contours of the future transaction, without obliging the parties to actually sign it. As we shall see, the LOI has many virtues, provided it is used wisely.

A letter of intent is useful for confirming one's intention to enter into negotiations. It has many advantages, provided it is well drafted.
