🏡 New changes to rental rules in Spain. What should landlords and tenants know?
For main residences, the new rules provide for renewals of five years—or seven if the landlord is a company—once the minimum rental term has ended, unless either party gives notice of non-renewal.
⚠️ If the landlord decides not to renew, they may have to compensate the tenant with at least twelve months’ rent for a comparable property. Exceptions apply, including when the property is needed as a permanent home for the landlord or certain family members.
What if both parties sign a renewal for just one year? Signing does not allow them to reduce the tenant’s mandatory legal rights.
For temporary rentals, there must be a genuine, verifiable reason for the temporary stay: simply writing “11 months” in the contract is not enough.
📌 The contract dates and renewal periods are essential. The published decrees are also awaiting ratification by the Spanish Congress.
