The Judiciary informs about the recent ruling issued by the Audiencia Provincial de Lugo, in which it rules in favour of the clients, so that the bank will return half of the notarial, administrative and appraisal expenses paid at the time of signing the mortgage.

It is the first time that they have spoken about this issue, affirming that the action of nullity is "imprescriptible" and, on that premise, it feels the criterion that the restitution derived from the effects of the nullity, that is to say, the term to claim the money to financial institutions is subject to "the generic term of five years."

The Hearing places the beginning of the calculation to demand the return of these mortgage expenses on January 23, 2019.

El Poder Judicial informa sobre la reciente sentencia dictada por la Audiencia Provincial de Lugo, en la que falla a favor de los clientes, para que el banco les devuelva la mitad de los gastos notariales, de gestoría y tasación pagados en el momento de suscribir la hipoteca.

Es la primera vez que se pronuncia sobre ello, afirmando que la acción de nulidad es “imprescriptible” y, sobre esa premisa, sienta el criterio de que la restitución derivada de los efectos de la nulidad, es decir, el plazo para reclamar el dinero a las entidades financieras está sometido “al plazo de prescripción genérico de cinco años”.

La Audiencia sitúa el inicio del cómputo para exigir la devolución de estos gastos hipotecarios en el 23 de enero de 2019.

It is ilegal for the bank to now charge maintenance fees for the bank account used to pay the mortgage.

The High Court of Barcelona (Audiencia Provincial), in a sentence on the 31/01/2019, declared the practice of charging maintenance fees for the account opened in the entity in order to pay the mortage fees, as an abusive practice, as this consists of a required action for the mortgage contract.

In this case, the consumer challenges the imposed clause, which states the requirement to pay on direct debit the monthly mortgage payment in an account opened at their own bank, and then will charge improper maintenance fees.

In addition, the High Court recognises in the sentece the right of the consumer to be compensated for the moral damage caused by the collection of undue commission, making the bank pay the consumer 500 euros.

NUEVA ACTUALIZACIÓN SOBRE ACCIDENTES

Modificación introducida por la Ley Orgánica 2/2019, de 1 de marzo, de Reforma de la Ley Orgánica10/1995, de 23 de noviembre del Código Penal, en materia de imprudencia en la conducción de vehículos a motor o ciclomotor y sanción del abandono del lugar del accidente.

La presente Ley Orgánica con vigencia desde el 3 de marzo de 2019 responde a una importante demanda social, ante el incremento de accidentes en los que resultan afectados peatones y ciclistas por imprudencia en la conducción de vehículos a motor o ciclomotor, y se asienta sobre tres ejes:
1. La introducción de tres supuestos que se van a considerar imprudencia grave por disposición de la ley, así como una interpretación auténtica de la imprudencia menos grave.
2. El aumento de la punición de este tipo de conductas.
3. La introducción del delito de abandono del lugar del accidente.
El aumento de la punición de este tipo de conductas se propone a través de dos vías.
Por un lado, la introducción de un nuevo artículo 142 bis del Código Penal. La redacción permitirá al Juez o Tribunal imponer la pena de hasta nueve años de prisión en caso de varios fallecidos, o fallecidos y heridos graves, causados por la imprudencia en la conducción de vehículos a motor.
