Although it is not expressly mentioned in the horizontal property law that the president is the one with the faculties to chair the meeting, this is commonly accepted in resemblance with the Spanish corporate law and other similar rules that deal with this kind of meetings. Nowadays many neighbours in communities have a dog. Most of them cause no problems to the rest of the owners but, unfortunately dogs could be a nightmare for the neighbours. A flat is not the perfect place for some dogs, so they get nervous and start to bark causing nuisance in the community. Some other dogs miss the owners and start to cry as soon as the owner leave the house....

In some cases, it is just a consequence of mixing cultures; in others the reasons could be the lack of education of some neighbours; or we can even find cases in which the misbehaviour is just an easy revenge against the community or any particular neighbour....

Many people are astonished when the administrator says that there are no statutes in the community. Nevertheless, this is very common in Spain. In fact, the Horizontal Property Law ( LPH) is the one to resolve all the possible problems of a community. Before this LPH went into effect in 1960, the statutes were absolutely necessary for communities, but afterwards everything changed....

I have realized that many people are confused about when a decision has passed at a general meeting. First of all, we should know distinguished between three different kind of agreements: Some of them require the unanimous consent of the whole community ( modification of the statutes, quota coefficients, etc); Others need the vote in favour of 60% of the owner and quota coefficients (Installation or cancellation of general services, such a elevators, concierge, etc....

In this time of the year many foreigners come to Spain to enjoy their holiday homes and it would be the time to put everything in order. Especially your legal relationship with your community. 1.- Be aware that the official address and the email address you gave to your administration is still ok. According to the article 9, h) LPH, the owner is obliged to notify to the administrator his address in Spain in which he wants to receive the notification....

Everybody will agree that to conduct properly a meeting it would be necessary to have some control, and It would be logical to think that the right person would be the president in the meeting....
