📍 If you have a property for holiday rentals in Mijas (Málaga) or anywhere in Andalusia, this is important for you. The Andalusian Government is processing the new Sustainable Tourism Law, a regulation that tightens penalties to curb illegal tourist rentals.

🏛️ What does this new law include?

🔴 Very serious fines up to £600,000 for renting without registering the property in the Andalusian Tourism Registry.
🔴 Shared liability — rental platforms (Airbnb, Booking, etc.) may also be fined if they list properties without a VFT code.
🔴 Activity bans — owners or platforms could be barred from operating for up to one year.

✅ What can you do?

🟢 Register your accommodation as a VFT.
🟢 Comply with technical and planning requirements.
🟢 Include the registration number in all adverts.

Many owners are unaware they are already legally at risk. With the new law, the consequences are even more severe.

🚨 Important Update: A vacation rental contract has been annulled! 🚨

🏡 A couple who signed a vacation rental contract took the company to court, arguing that the contract didn’t specify the property or set a concrete period, which is against the law. They demanded a refund, including double reimbursement for prohibited advance payments.

🛡️ The company defended the contract and, if it were nullified, asked for the return of any enjoyed services.

⚖️ The courts declared the contract null and void, ordering the company to compensate the couple and return the prohibited advances with interest.

📢 The company appealed to the Supreme Court (SC), claiming the contract was valid and could be indefinite. However, the SC rejected the appeal, stating the contract failed to specify a property or period and didn’t explain the usage terms satisfactorily.

🏠 Rent Renewals Up by 3% in January, Matching Inflation! 📈 Latest CPI data for December closes at 3.1%, says INE.

📆 New 3% cap applies to annual lease renewals for primary residences, per LAU. Monthly rent for a typical 2-bedroom apartment now 803 euros, up by 23 euros/month or 275 euros/year.

🌆 In cities like Barcelona, Madrid, Palma, and San Sebastián, average rent exceeds 1,000 euros/month, with yearly increases over 320 euros, nearly matching inflation.

🏡 Since Jan 1, 2024, the Housing Law's 3% cap in effect for contract renewals if no agreement between landlord and tenant. From March 2022 to Dec 31, 2023, the cap was 2%.

💰 Leases signed in January will see an average increase of about 280 euros/year nationwide, with higher increases in major cities like Barcelona, Madrid, Palma, San Sebastián, Valencia, or Bilbao.
