New Single Tourist Rental Registry in Spain
On 2 January 2025, the Single Register of Leases and the Digital Single Window for Leases came into force, as established by Royal Decree 1312/2024, of 23 December. This regulation regulates the single registration procedure for short-term accommodation rental services.
What is the Single Registry of Leases?
The Single Register of Leases is a system that allows the collection and exchange of data relating to rental services for short-term accommodation. This register ensures transparency and facilitates oversight by local and national administrations. Registration not only benefits owners and platforms, but also protects tourists: by making sure that all properties comply with legal requirements, unfair competition is reduced and the quality of the service offered is improved.
Scope of Application of the Standard
The regulations will apply to tourist rentals, seasonal rentals, room rentals or other properties that allow short-term accommodation and that carry economic remuneration, as long as they are offered through transactional online platforms. The regulation will be mandatory for the services provided by online platforms to hosts offering short-term accommodation in Spain, regardless of the place of establishment of such platforms, as well as for the rental services provided by the hosts.
Digital Single Window for Leases
In order to comply with the obligations prescribed in the new regulations, the Digital Single Window for Leases of Spain is created, as a single national digital gateway for the electronic transmission of data between online short-term rental platforms and for the rest of the functions established by the regulations. This Window will be dependent on the Ministry of Housing and Urban Agenda through the General Directorate of Planning and Evaluation. The Digital Single Window allows procedures related to the registration and consultation of data to be carried out, promoting efficient and agile management for citizens and administrations.
Obligations of Owners and Platforms
• Owners: They are obliged to obtain a registration number for the rental property, provide the required information, meet the information requirements, update it in case of changes and communicate to the online platforms the registration number assigned by the Property Registry or the Movable Property Registry.
• Platforms: They must ensure that landlords identify their homes by means of this number in their applications, allow the number to be visible in advertisements, carry out random and periodic checks, and inform the Digital Single Window of the negative results of these checks. They must also inform landlords about the registration procedure.
Registration Procedure
The procedure will be initiated at the request of the interested party. The application for a unique registration number must be submitted to the electronic headquarters of the Association of Property and Commercial Registrars of Spain, attaching all the mandatory documentation in electronic format. The application may also be submitted on paper to the competent Land Registry or Movable Property Registry.
Documentation required to obtain the registration number
This is the documentation that must be submitted for the new registration of tourist flats, essential to ensure that the property meets the required standards:
• License for tourist use of the Autonomous Communities
• Certificate of Occupancy
• Cadastral reference and exact address of the property
In addition, it is also necessary to indicate whether the intention is to rent the entire home or by rooms, the maximum number of people who will be able to use it and show that it meets all the specific requirements of the Autonomous Community in which the property is located.
Adaptation Period
Although the regulations came into force on January 2, 2025, its provisions will not be effective until July 1, 2025. This period allows the necessary technological and functional adaptations to be made by all the actors involved.
Mandatory and Compliance with Administrative Resolutions
Among the main novelties of this regulation is the obligation to register all homes intended for tourist and seasonal rental through the Single Registry of Leases, if you do not do so, you will not be able to advertise your accommodations on digital platforms and you may receive economic sanctions, as well as the possible suspension of your property as a tourist rental.
Platforms must comply within 48 hours with administrative resolutions ordering the removal or disabling of ads linked to a suspended or removed registration number.
