Ley de eficiencia de la Justicia. IMPORTANT CHANGES

The Organic Law 1/2025, of January 2, introduces measures to improve the efficiency of the Public Justice Service in Spain. Among its main objectives are the modernization of judicial processes, the reduction of workload in the courts, and the improvement of access to justice for citizens.
One of the key measures is the digitization of judicial procedures, which includes the implementation of electronic systems for document submission and case management. This aims to streamline processes and facilitate access to information for all parties involved.
The law also promotes the use of alternative dispute resolution methods, such as mediation and arbitration, to relieve court congestion and offer faster and more economical solutions to legal disputes.
Additionally, reforms are introduced in the organization and functioning of the courts, in order to optimize available resources and improve coordination between different judicial bodies.
Together, these measures aim to create a more efficient, accessible, and adaptable justice system to meet the current needs of society.

🏠🔍 Important update on tourist rentals in homeowners' associations! Starting April 3, 2025, communities can prohibit these rentals with the agreement of three-fifths of the owners, according to the reform of the Horizontal Property Law and Supreme Court rulings from October 3, 2024. This prohibition is not retroactive, meaning owners who were already renting their properties for tourism before this date can continue under the current tourism sector regulations. If the community's statutes already prohibit tourist use, the community can order the cessation of the activity. Additionally, if the statutes prohibit commercial activities, the Supreme Court has determined that tourist rentals are considered commercial, so they can also be prohibited. If there are no prohibitions in the statutes, owners can engage in tourist rentals, provided they obtain the necessary administrative authorizations. To prohibit tourist rentals, the community must hold a meeting of owners and register the agreement in the Property Registry, ensuring future buyers are informed and bound by the restriction. New Single Tourist Rental Registry in Spain

On 2 January 2025, the Single Register of Leases and the Digital Single Window for Leases came into force, as established by Royal Decree 1312/2024, of 23 December. This regulation regulates the single registration procedure for short-term accommodation rental services.

What is the Single Registry of Leases?

The Single Register of Leases is a system that allows the collection and exchange of data relating to rental services for short-term accommodation. This register ensures transparency and facilitates oversight by local and national administrations. Registration not only benefits owners and platforms, but also protects tourists: by making sure that all properties comply with legal requirements, unfair competition is reduced and the quality of the service offered is improved.

Scope of Application of the Standard

The regulations will apply to tourist rentals, seasonal rentals, room rentals or other properties that allow short-term accommodation and that carry economic remuneration, as long as they are offered through transactional online platforms. The regulation will be mandatory for the services provided by online platforms to hosts offering short-term accommodation in Spain, regardless of the place of establishment of such platforms, as well as for the rental services provided by the hosts.

Digital Single Window for Leases

In order to comply with the obligations prescribed in the new regulations, the Digital Single Window for Leases of Spain is created, as a single national digital gateway for the electronic transmission of data between online short-term rental platforms and for the rest of the functions established by the regulations. This Window will be dependent on the Ministry of Housing and Urban Agenda through the General Directorate of Planning and Evaluation. The Digital Single Window allows procedures related to the registration and consultation of data to be carried out, promoting efficient and agile management for citizens and administrations.

Obligations of Owners and Platforms

• Owners: They are obliged to obtain a registration number for the rental property, provide the required information, meet the information requirements, update it in case of changes and communicate to the online platforms the registration number assigned by the Property Registry or the Movable Property Registry.

• Platforms: They must ensure that landlords identify their homes by means of this number in their applications, allow the number to be visible in advertisements, carry out random and periodic checks, and inform the Digital Single Window of the negative results of these checks. They must also inform landlords about the registration procedure.

Registration Procedure

The procedure will be initiated at the request of the interested party. The application for a unique registration number must be submitted to the electronic headquarters of the Association of Property and Commercial Registrars of Spain, attaching all the mandatory documentation in electronic format. The application may also be submitted on paper to the competent Land Registry or Movable Property Registry.

Documentation required to obtain the registration number

This is the documentation that must be submitted for the new registration of tourist flats, essential to ensure that the property meets the required standards:

• License for tourist use of the Autonomous Communities
• Certificate of Occupancy
• Cadastral reference and exact address of the property

In addition, it is also necessary to indicate whether the intention is to rent the entire home or by rooms, the maximum number of people who will be able to use it and show that it meets all the specific requirements of the Autonomous Community in which the property is located.

Adaptation Period

Although the regulations came into force on January 2, 2025, its provisions will not be effective until July 1, 2025. This period allows the necessary technological and functional adaptations to be made by all the actors involved.

Mandatory and Compliance with Administrative Resolutions

Among the main novelties of this regulation is the obligation to register all homes intended for tourist and seasonal rental through the Single Registry of Leases, if you do not do so, you will not be able to advertise your accommodations on digital platforms and you may receive economic sanctions, as well as the possible suspension of your property as a tourist rental.

Platforms must comply within 48 hours with administrative resolutions ordering the removal or disabling of ads linked to a suspended or removed registration number.

At Tax Law Zavala&Moscoso we are at your disposal to carry out any of the necessary procedures or clarify your doubts in this regard

End of residence permits for investors: the government will end the 'golden visa' in April

Next April will mark the end of the 'golden visa' in Spain. This measure, announced by the President of the Government, Pedro Sánchez, seeks to put an end to residence permits granted to foreign investors in exchange for significant investments in the country.

Since their implementation in 2013, golden visas have been a key tool for attracting foreign capital, especially in the real estate sector. However, they have also been criticized for possible risks of real estate speculation and lack of control over the origin of the funds.

Although investment in real estate is the most used to access residence, under that article 63 that will be without effect from April, other cases are enabled to obtain visas. In addition to those who acquire a home of more than half a million euros, those who invest more than two million in Spanish public debt securities or more than one million in shares or shares of Spanish capital companies with a real business activity can access it.

With the entry into force of the new regulations, applications submitted before the deadline will be respected, but no more permits will be granted from April. This decision is part of a series of measures to improve the efficiency of the public justice service and reflects a significant change in the country's migration and economic policy.

The text includes a transitional provision to respect the visa for those investors or relatives of investors who had applied for it prior to the date of entry into force of the law.

What do you think about this measure? Do you think it will negatively affect attracting foreign investment in Spain?

Exploring Tax Advantages in Estonia

Estonia, often hailed as one of the most business-friendly countries in the world, offers a range of tax advantages that make it an attractive destination for entrepreneurs and businesses. Let's delve into some of the key benefits:

1. Corporate Income Tax
Estonia operates on a unique tax system where corporate income tax is only levied on distributed profits. This means that as long as profits are reinvested in the business, they remain untaxed. This incentivizes businesses to reinvest in growth and innovation.

2. Simple Taxation System
Estonia boasts one of the simplest and most transparent tax systems in the world. The flat tax rate for both personal and corporate income tax is 20%. This straightforward approach reduces administrative burdens and makes tax compliance easier for businesses.

3. E-Residency Program
Estonia's e-Residency program allows entrepreneurs from around the world to establish and manage an EU-based company entirely online. This digital nation initiative provides access to Estonia's business environment and offers a host of benefits, including the ability to use online banking, sign documents digitally, and file taxes online.

4. No Withholding Taxes
Estonia does not impose withholding taxes on dividends, interest, or royalties paid to non-residents. This can be a significant advantage for foreign investors and businesses engaged in international transactions.

5. Social Tax Cap
Estonia has a cap on social taxes, which limits the amount of social tax paid by employers on high salaries. This can make Estonia an attractive destination for high-earning individuals and businesses seeking to attract top talent.

6. Double Taxation Treaties
Estonia has an extensive network of double taxation treaties with numerous countries. These treaties help to prevent double taxation of income and provide tax relief for businesses engaged in cross-border activities.

Estonia's tax advantages, combined with its innovative digital infrastructure and business-friendly policies, make it a compelling choice for entrepreneurs and businesses looking to thrive in a dynamic and supportive environment.
