CAN A PERSON WHO IS NOT RESIDENT REGISTER A CAR IN SPAIN??

Some clients have contacted us in the past to complain that at the Traffic Department in Cádiz they have been told that a non-resident in Spain cannot register a car in Spain. This is completely untrue and it is actually allowed by law. The problem is that the Spanish authorities do not like registering vehicles in Spain in the name of non-residents because it makes it difficult for them to send notifications of fines, but it is perfectly possible to do so.

“En el supuesto de extranjeros que no tengan Tarjeta de Residencia, presentarán documento de identidad del país de origen, si se trata de ciudadanos de Estados parte en el Acuerdo sobre el Espacio Económico Europeo (EEE), o Pasaporte o Certificado de Nacionalidad si se trata de ciudadanos de terceros países, y además justificarán su domicilio en España mediante cualquier documento que así lo acredite, tales como la propiedad o alquiler de una vivienda, o estar censado en algún Municipio”.

“Foreigners who do not hold a residency card must show their identity card issued by their country of origin, if they are citizens of states party to the European Economic Area (EEA) Agreement, or their passport or certificate of nationality if they are citizens of third countries, and they must also show proof of their address in Spain in the form of any document that proves this, for example proof of property ownership or rental or registration in a population register”.
If you are asked for proof of address, by law you are allowed to show your rental agreement or property deed (if the deed is older than 6 months you might be asked for an up-to-date nota simple from the land registry that proves you own a house in Spain). These documents will be considered proof that you have an address in Spain to which you can register your car, and the authorities will have to abide by the law, however much they don’t like it!

A client asked me today to include in his will some dispositions on how to proceed in case he was me mentally or physically incapacitated and he would lose control on his body and suffering pain with no quality of life, in the sense of not being kept alive. I told him this not something you should put in your will as the will is only available for the heirs when death happens.
In this case what needs to be done is to issue and register a document called: Advance Health Care Directive
I have found a guide in English which could be useful to understand how it works.
Having said that I hope you live long years and stay healthy. This is just in case someone finds it useful!!
