Happy Sant Jordi to everyone!

La Diada de Sant Jordi, also known as El dia de la Rosa (The Day of the Rose) or El dia del Llibre is a Catalan holiday held on 23 April, with similarities to Valentine's Day and some unique twists that reflect the antiquity of the celebrations.

The main event is the exchange of gifts between sweethearts, loved ones and colleagues. Historically, men gave women roses, and women gave men a book to celebrate the occasion — "a rose for love and a book forever."

In modern times, the mutual exchange of books is also customary. Roses have been associated with this day since medieval times, but the giving of books is a more recent tradition originating in 1923, when a bookseller started to promote the holiday as a way to commemorate the nearly simultaneous deaths of Miguel Cervantes and William Shakespeare on 23 April 1616. Barcelona is the publishing capital of both Catalan and Spanish languages and the combination of love and literacy was quickly adopted.

Are you planning to buy a property and then rent it out for a secure income?

In recent years holiday lets income in Spain has been an explosion in the market for holiday rental of flats in certain areas of Spain. From the legal point of view there are two legal issues to consider.

License to rent the flat as a holiday let. A license allowing the flat to be let for holiday lets needs to be obtained from the town hall /or local authority. Quotas for licenses may vary even in the same city for different districts. In some areas no new licenses are issued. It is worth getting advice before embarking on this activity.

From the tax point of view holiday lets fall in the same category as hotel rooms in terms of VAT. At present 10% VAT needs to be charged, therefore quarterly VAT tax forms must be submitted and an annual declaration at the end of the tax year needs to be submitted too. All income needs to be included in the tax form as income, either as a resident if the person receiving the income is resident in Spain or, if not, as non-resident (modelo 210). The owner must issue their clients with an invoice showing VAT separately.

If the owner is a non-resident, he/she will have to register for VAT and nominate a representative in Spain.

This is an important point to make since a big part of the market seems to ignore these crucial issues, recent cases initiated by the tax office have ended up with hefty fines for owners; tax authorities are making sure that due tax and VAT is paid for all rental incomes. It is worth noting that Energy Companies are obliged to submit energy consumption data to the tax office quarterly so that proper cross-checks can be made and fraud detected. Please ask for further info.
