First of all, it's your residence in Spain! The first step is to define your legal status in Spain – your residence permit.

❓Is it difficult to get it?

The term for considering applications takes from 1 to 3 months (this is according to the Law), but in practice, it can now take up to six months.

What to do if my bank account has been blocked?

Almost every foreigner has faced this problem while living in Spain.

Why the account may be blocked?

➡️The KYC (know your client) procedure has not been completed

➡️There is no proof of the origin of the funds
Spanish banks must act in accordance with Law 10/2010 from 28 of april on the prevention of money laundering and terrorist financing checking the origin of the funds of their clients and sometimes their destination. For this reason, any lack of the client's documentation in the system can cause the blocking of the account.

And we are still about taxes for 2021! So let’s see what taxes do you need to present this month?

❗️Be sure to add these dates on your calendar!

It is very important to pay and present taxes on time! Otherwise we can expect fines and sanctions. And who needs them?

🔹 January 15 - the last day of automatic tax with a preliminary current account according to templates 111 and 115.

🔹20 January - the last day submitted reports 111 and 115. Note that the tax itself must be paid.

🔹 January 26 - the last day of auto-writing of tax with a preliminary settlement invoice according to templates 130 and 303

🔹21 January - the last day for filing declarations 130 and 3030, as well as summary reports 349

Qué impuestos hay que presentar este mes?

❗️Asegúrate de añadir estas fechas a tu calendario! Es muy importante pagar y presentar los impuestos a tiempo.

De lo contrario, te pueden llegar multas y sanciones.

Vamos a ver esas fechas:

🔹 15 de enero - el último día para domiciliar los impuestos tu cuenta de los modelos 111 y 115.

🔹20 de enero: último día para presentar los modelos 111 y 115. Ten en cuenta que el impuesto tiene que ser pagado antes de presentrlo.

🔹 26 de enero - el último día para domiciliar los impuestos tu cuenta de los modelos 130 y 303

🔹21 de enero - último día para presentar las declaraciones 130 y 303, así como los informes 349

Calendario laboral del año 2022.

Ya ha legado el Año Nuevo! 🎄Esperamos que todos lo hayáis pasado genial con los amigos y familiares y habéis disfrutado mucho de estos días de descanso.

Siguiendo la línea del descanso, hoy dejamos a vuestra disposición el calendario laboral actualizado del año 2022.

Gracias al calendario, se puede saber qué días son festivos y con lo cual planificar el negocio y organizar los cuadrantes de los trabajadores.

Los festivos oficiales en Catalunya son los siguientes:

We just got positive resolution on one of our cases!

This case was quite complex. The client has come to our office after receiving a previous denial in her application for a Spanish residency permit.

The key to success, in this case, was the application of the latest modification in the migrational legislation.

And that was the possibility of being linked to one of the family members who resides in Spanish territory.

Acabamos de recibir muy buena noticia y es la resolución favorable en uno de los casos!

Este caso fue bastante complejo. El cliente acudió a nosotros ya habiendo recibido una denegación a su solicitud de permiso de resedencia.

La clave del éxito fue la referencia que se hizo a la última modificación de la ley de inmigtación.

La modicación era que el solicitante podía vincularse a uno de los mielbros de la familia que ya reside en el territorio español.

Corporate tax reduced rate.
❓Do you know when you can't apply it?

Corporate tax for spanish companies is 25%, no matter in which province in Spain your company is situated.
Resident companies are taxed on their worldwide income, samely as natural persons.

➡️Newly created companies are taxed at a 15% tax rate, which applies to the first two years in which the company obtains a taxable profit.

❌This tax rate does not apply to:

🟢equity companies (i.e. companies that do not carry on business activity),

🟢newly created companies that are part of a national or international group,

🟢if the company's business activity was previously carried on by a related company or individual.

Impuesto sobre sociedades. Tipo de gravamen reducido.
❓Sabes cuándo se puede aplicar?

El impuesto sobre sociedades es del 25%. El tipo de gravamen no depende de la provinica en que esté establecida la sociedad.
Las empresas residentes están obligadas a declarar sus ingresos mundiales, igual que las personas físicas

➡️ La ventaja para las empresas de nueva creación: el tipo de gravamen reducido del 15%, que se aplica en el primer año cuando la empresa tenga eneficio y en el siguiente.

❌Esta reducción no se aplica a:

🟢 A las sociedades mercantiles que tengan la consideración de entidad patrimonial.

🟢 Si la actividad ha sido desarrollada por personas o entidades vinculadas, y ha sido transmitida, por cualquier título jurídico, a la entidad de nueva creación (administrador, socios..etc)

🟢 Si la actividad ha sido ejercida durante el ejercicio anterior a la constitución de la entidad por una persona física que ostente una participación directa o indirecta en el capital de la Sociedad superior al 50%.

The choice of legal structure - one of the first questions to come up when you start a business in Spain.

So what LEGAL STRUCTURES exist in Spain?

First, let's see the often-used legal structures, and then not so commonly used ones.

➡️The often- used are

1️⃣Spanish company with its own legal personality
🔹Sociedad Limitada (S.L.) (Limited Liability Company)
