أصدرت محكمة القاهرة الجديدة، حكماَ قضائياَ فريداَ من نوعه، بالخلع بين زوجين أجنبيين "سوريين"، وذلك بعد فشل محاولات الصلح بينهما من جانب مكتب التسوية.

1- تأكد من وجود أوراق ملكية أرض العمارة المقامة بها الشقة وهل هي ملكية لشخص أم عدة أشخاص و أن الملكية خالصة لهم أرضاً وبناء أو بنظام المشاركة أي معهم شريك حتى يتسنى التوقيع على العقد من البائع الرسمي للعقار.
2- فى المناطق الغير عشوائية ) التأكد من رخصة المباني من حيث صدورها من الجهة المختصة وعدد الأدوار المرخص بها حتى تتأكد من وجود الشقة المزمع شراؤها ضمن الأدوار المرخص بها وبأنها ليست بالأدوار المخالفة للرخصة حتى لا تتعرض لإزالة الدور المقام به الشقة من الجهة المختصة.
3- ان يشمل عقد الشراء على بند الثمن و المساحة و نسبة الأرض الشائعة لتلك الشقة ومواصفات الشقة المباعة من جميع أوصافها والدور المقامة فيه و أي شرط غير مفهوم بالعقد يجب مراجعة الجهة البائعة قبل التوقيع حتى لا يكون هناك بنود إذعان أو إلغاء لحق دون فهمه.
4- التأكد من أن البائع أو البائعين ملتزمون بالعقد بالحضور بوكيل عنهم أمام الجهات المختصة أو المحكمة المختصة للإقرار بنفاذ البيع أو صحة توقيعهم على العقد عند طلب ذلك.
5- عند سدادك الثمن إن كان جميعه نقدا تأكد من العقد بإثبات أن الثمن خالص جميعه وأن التوقيع يعتبر مخالصة بهذا الثمن وإن كان على دفعات تأكد من أن المقدم المدفوع مذكور وأن الدفعات المؤجلة مثبتة بالعقد بالمبلغ والتاريخ لكل سداد وأن إجمالي كل هذا يساوى الثمن المتفق عليه وهو قيمة الشقة إجمالاً.
6- لابد من الحصول على صورة من جميع أوراق الملكية للأرض والرخصة، إضافة إلى عقد البيع «مستندات الملكية».
7- التأكد من وجود شرط جزائي على من يخالف أياً من بنود العقد سواء مواعيد السداد أو مواعيد التسليم للشقة أو أي التزام آخر بالعقد مع نفاذ العقد.
النصيحة الاخيرة حتى تضع يدك على الشقة (حيازتها) عند تسلمها والشروع في استكمال ما هو مطلوب من تشطيبات وخلافه ليكون شراؤك قد تم بمستندات ملكية وحيازة على الطبيعة.
