أضاف مكتب بدران نجاحًا جديدًا إلى سجل نجاحاته بتمكنه من حماية حقوق السيد/ محمد ابراهيم سرور مالك العلامة التجارية "بيت ورد" من المعتدين عليها داخل النطاق الجغرافي لجمهورية مصر العربية وذلك عن طريق صدور حكم نهائي من محكمة القاهرة الاقتصادية بوقف التعدي على العلامة التجارية ووقف استعمالها مع ما يترتب على ذلك من آثار فصلها الحكم، وذلك بالإضافة إلى التعويض.
وكان من أهم ما رسخ إليه الحكم في أسبابه الآتي:
1- بطلان شرط التحكيم الوارد في عقود الامتياز التي تتضمن نقل معرفة يتم استخدامها في جمهورية مصر العربية إذا كان القانون واجب التطبيق وفقًا لاتفاق التحكيم قانون مغاير لقوانين جمهورية مصر العربية.
2- اسباغ الحماية الإقليمية على العلامات التجارية المسجلة بمصر، رهينة باستعمال تلك العلامات مدة لا تقل عن خمس سنوات، وهو الأمر الذي يتحقق حال منح استغلال العلامة في مصر للغير.
3- السكوت عن استعمال الشرط الصريح الفاسخ لا يعتبر تنازلا عنه ما لم يقترن بسلوك صادر ممن قرر لمصلحته الشرط ينبئ بصورة واضحة عن أنه قد قصد التنازل.
4- نسبية أثر العقود فلا يلتزم بها أو يستفيد منها إلا أطرافها، ما لم تقم حالة قانونية تكسب الغير حقا عليه.

We are glad to announce that Badran Law Firm succeeded in protecting Mr. Mohamed Ibrahim Sorour’s intellectual property rights ("Beit Ward" trademark), against numerous infringements in Egypt. The Cairo Economic Court rendered a final decision that ordered the cessation of the trademark violation and granted monetary damages.
The decision establishes the following key principles:
1. An arbitration clause is considered null and void if it is in a franchise agreement that includes knowhow transfer in Egypt, when the applicable law to the dispute is a non-Egyptian law.
2. Enforcement of trademark protection in Egypt necessitates the usage of the trademark for a period of no less than five years, which is fulfilled by licensing a third party to use the trademark.
3. Failure to exercise an explicit termination clause does not imply its waiver, unless it can be evidenced that said failure was in fact a waiver.
4. Privity of contract only affects parties to the contract, unless a legal matter grants rights to a third party with regard to the contract.

Badran Law Firm is pleased to announce that Ms. Maya Khairy has joined our firm as a Junior Associate in our Dispute Resolution Department.

Maya joined our Firm in October 2025.

She is an accomplished practitioner noted for her dedication and analytical thinking in legal practice.

Maya graduated from the Faculty of Law (English Section), Cairo University, achieving excellent grades throughout her academic years, ranking second in her class. As part of her academic and professional development, she completed a specialized course in intellectual property with the World Intellectual Property Organization (WIPO).

She has developed practical experience with diverse law firms and legal departments. Her practice focuses primarily on arbitration, with additional expertise in construction, intellectual property, employment and labor law, corporate law, investment and other related legal fields.

يتشرف مكتب بدران للمحاماة والاستشارات القانونية بالإعلان عن نجاحه في حماية حقوق أحد أكبر شركات السمسرة وتداول الأوراق المالية في السوق المصري وذلك بصدور حكم من محكمة القاهرة الاقتصادية لصالحها في دعوى تجاوز قيمتها ثلاثمائة مليون جنيه مصري.
وقد تطرقت الدعوى لمسائل عديدة متعلقة بالشراء بالهامش والتداول بالبورصة المصرية وتم إيضاح كافة المسائل الفنية والمالية للخبير المعيّن من المحكمة في الدعوى.

Badran Law Firm has succeeded protecting the rights of one of the large brokerage companies in the Egyptian market we have managed to obtain a favourable court ruling form the Cairo Economic courts in a dispute evaluated at 300 million EGP.
This case touched on many topics related to margin trading and stockbroking; the matter was further deliberated before a court appointed expert prior to the ruling.

Nancy Ashour joined Badran Law Firm in September 2025, focusing on corporate governance and mergers & acquisitions (M&A). Congratulations to Ms. Karin Soliman on earning her master’s degree (LL.M. in International and European Business Law (Master parcours Droit international et européen des affaires) from Sorbonne Paris 1) with a grade of very good. We are thrilled to announce that Karin has joined our team as a junior Associate in our corporate Department.

Karin Soliman joined Badran Law Firm in March 2025, specializing in Mergers & Acquisitions (M&A) and Corporate Governance. She leverages a robust international legal education, having graduated in 2024 with a double degree in International Business Law from Cairo University and École de Droit de la Sorbonne (Sorbonne Law School), which provides her with expertise in both the Egyptian and French legal systems.

Karin further solidified her expertise by obtaining an LL.M. in International and European Business Law (Master parcours Droit international et européen des affaires) from Sorbonne Paris 1, with an advanced focus on arbitration and litigation.

Mr. Darwish is a corporate lawyer (Associate) with four years of experience focused on company formation, governance and contract drafting and review.
