🟥 Arrest campaigns targeting lawyers in Egypt contravene the UN Basic Principles on the Role of Lawyers

◾ The Arab Center for the Independence of the Judiciary and Legal Profession (ACIJLP) and the Justice Support Foundation express their profound concern and strong condemnation regarding the arrest campaign targeting lawyers and political activists following their support for the families of detainees and their calls for the release of prisoners of conscience who continue to face prolonged pretrial detention for expressing their opinions, beliefs, and ideas.

◾ Since the evening of 24 May 2026 and continuing into the morning of today, security forces arrested two coordinators from the Defense Committee for Prisoners of Conscience, lawyer Mohamed Abul-Diyar and human rights advocate Ms. Wafaa Al-Masri, who was arrested from her home this morning, after they had organized a solidarity gathering with the families of detainees to express the ongoing suffering caused by the continued detention of their relatives.

🔴حملات القبض على المحامين فى مصر
مخالفة لمبادىء الأمم المتحدة بشأن دور المحامين

◾يعرب المركز العربى لإستقلال القضاء والمحاماة و مؤسسة دعم العدالة عن إنزعاجهما وإستنكارهما الشديدين ضد حملة القبض على محامين ونشطاء سياسيين على أثر دعمهم لأهالى السجناء ومطالبتهم بالإفراج عن سجناء الرأى الذين يواجهون حالات حبس إحتياطى مطول بسبب تعبيرهم عن آرائهم ومعتقداتهم وأفكارهم .

◾فمنذ مساء أمس 24 مايو 2026 وحتى صباح اليوم ألقت قوات الأمن القبض على مقررى لجنة الدفاع عن سجناء الرأى الأستاذ المحامى محمد أبو الديار ولحق ذلك القبض على الأستاذة الحقوقية وفاء المصرى صباح اليوم من منزلها، وذلك على أثر تنظيم لقاء تضامنى مع أهالى السجناء للتعبير عن معاناتهم المستمرة بسبب حبس ذويهم .

◾ويؤكد المركز العربى على أن إستهداف المحامين بسبب أو أثناء قيامهم بأعمالهم ودفاعهم عن عملائهم يعد إنتهاكا للعهد الدولى للحقوق المدنية والسياسية وكذلك لمبادئ الأمم المتحدة بشأن دور المحامين التى أقرتها الجمعية العامة 1990 ، والتى تحظر تعريض المحامين إلى التهديد أو الملاحقة القانونية أو العقوبات الإدارية والإقتصادية وغيرها نتيجة قيامهم بعمل يتفق مع واجبات ومعايير وآداب المهنة المعترف بها .

◾والمركز إذ يؤكد على رفضه لتلك الإجراءات والإنتهاكات التى طالت كلا من الأستاذ محمد بو الديار المحامى والأستاذة وفاء المصرى المحامية ، فإنه يطالب السلطات المصرية بسرعة الإفراج عنهم دون قيد أو شرط . ويدعو الحكومة المصرية إلى الإلتزام بتعهداتها الدولية ، خاصة العهد الدولى للحقوق المدنية والسياسية الذى صادقت عليه الحكومة المصرية وأصبح جزء من التشريع الداخلى بموجب أحكام الدستور ..

🔴 جلسة تأكيد التهم فى قضية خالد الهشرى امام المحكمة الجنائية الدولية

🟩 تستمر اليوم 20 مايو2026 جلسات تأكيد التهم فى قضية المسؤل الليبيى خالد الهشرى امام المحكمة الجنائية الدولية، وتستمر حتى غدا 21 مايو 2026 امام الدائرة التمهدية الاولى والتى من المقرر ان تصدر قرارها خلال 60 يوم من تاريخ انتهاء جلسات تأكيد التهم بعد التاكد من ان هناك ادلة كافية للاعتقاد بان السيد خالد الهشرى قد ارتكب الجرائم المنسوبة اليه فى مذكرة الادعاء .
ويزعم ان السيد خالد الهشرى والذى كان مسؤلا عن احد الجماعات المسلحة الليبية والتى تدعى ( قوات الردع ) ثم اصبح مسؤل رسميا عن احد السجون الليبية ( سجن معتيقة ) ، قد ارتكب جرائم حرب وجرائم ضد الانسانية بلغ عددها 17 جريمة فى الفترة من 1 مايوم2014 وحتى 30 يونيو 2020 ، وقد شملت مذكرة الاتهام التى اصدرها المدعى العام للمحكمة الجنائية الدولية ان السيد خالد الهشر يشتبه بانه قد ارتكب جرائم القتل والتعذيب والاغتصاب والاستعباد والاضطهاد و الاعتداء على الكرامة الانسانية والحرمان الشديد من الحرية البدنية .والاعمال اللاانسانية الاخرى ضد محتجزين كانوا تحت سيطرتة بسج معتيقة فى الاراضى الليبية .
ومن المقرر ان تصدر الدائرة التمهيدية الاولى قرارها بشأن اعتماد التهم بعد سماع الادعاء العام ودفاع المتهم والممثليين القانونين للضحايا خلال 60 يوما وفقا لاحكام النظام الاساسى للمحكمة الجنائية الدولية .

◾ Egyptian authorities lift travel ban on Hoda Abdel-Wahab

After 15 years of security-related pursuit and more than 10 years under a travel ban, the Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP) has learned, through the Office of the Egyptian Public Prosecutor and the Passports and Immigration Department at the Ministry of Interior, that the Egyptian authorities have decided to remove Ms Huda Abdel-Wahab, Executive Director of the ACIJLP from the travel ban lists imposed on her since 2016. It should be noted that no official response or formal documentation has yet been received regarding the resolution of the legal status of the Arab Center and its staff in Case No. 173 of 2011 concerning civil society organizations.

On 28 December 2011, the ACIJLP and five other foreign organizations operating in the field of human rights were subjected to security raids, and their offices were closed in what later became known as Case No. 173 of 2011 concerning civil society organizations, which ultimately resulted in the acquittal of all defendants working in the foreign organizations.

🔵 السلطات المصرية ترفع اسم هدى عبد الوهاب من قوائم الممنوعين من السفر .

بعد 15 عام من الملاحقة الامنية واكثر من 10 سنوات من المنع من السفر، علم المركز العربى لاستقلال القضاء عبر مكتب النائب العام المصرى، وإدارة الجوازات والهجرة بوزارة الداخلية ، بان السلطات المصرية قد قررت رفع اسم الاستاذة هدى عبد الوهاب المدير التنفيذي للمركز العربى من قوائم الممنوعين من السفر المفروض عليها منذ عام 2016 ، علما باننا لم نتلقى حتى الان اى رد رسمى او اوراق رسمية بشأن انهاء الموقف القانونى للمركز العربى لاستقلال القضاء والعاملين به فى القضية منظمات المجتمع المدنى رقم 173 لسنة 2011.

ويذكر ان المركز العربى وخمس منظمات اجنبية اخرى عاملة فى مجال حقوق الانسان كانوا قد تعرضوا لمداهمات امنية بتاريخ 28 ديسمبر 2011 ، واغلقت مقراتها فيما عرف بعد ذلك بالقضية 173 لسنة 2011 الخاصة بمنظمات المجتمع المدنى، والتى انتهت ببراءة جميع المتهمين العاملين بالمنظمات الاجنبية .

الا انه واعتبارا من عام 2015 اعيدت الملاحقة الامنية لمنظمات المجتمع المدنى المصرية، وفى يونية2016 تم منع المدير التنفيذى للمركز العربى الاستاذة هدى عبد الوهاب من السفر ثم تبعها منع باقى نشطاء المجتمع المدنى المصرى. ورغم رفع قيود المنع السفرعن كل النشطاء المصرين ، الا انها ظلت قيد المنع من السفر.
وقد تظلم المركزعدة مرات من هذا القرار امام مكتب النائب العام المصرى، وكان اخرها التظلم رقم 21353 فى 2 ابريل 2024 ، وقد ابلغنا شفاهة برفع اسم هدى عبد الوهاب من قوائم الممنوعين من السفرعلى خلفية القضية 173 لسنة 2011،

◾ The ruling against the President of the Tunisian Judges Association is a violation of Tunisia’s judicial Independence

The Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP) expresses its strongest condemnation of the ruling issued against the notable judge Anas Al-Hammadi, President of the Tunisian Judges Association, by the Court of First Instance in Tunis on 6 April, sentencing him to one year’s imprisonment in connection with his exercise of his right, as a judge, to engage in public matters and to defend the independence of the judiciary in Tunisia. The ACIJLP considers that Judge Al-Hammadi exercised his legitimate right, in his capacity as a judge and President of the Tunisian Judges Association, to defend judicial independence and to protect its members against interference by the executive authority in the work of the Tunisian judiciary, in accordance with the United Nations Basic Principles on the Independence of the Judiciary, adopted by the United Nations General Assembly in December 1985. Articles 7 and 8 of these Principles affirm that members of the judiciary, like other citizens, are entitled to freedom of expression, belief, association, and assembly, and that judges have the right to form associations or other organizations to represent their interests, promote their professional training, and safeguard their independence.

◾ الحكم على رئيس جمعية القضاة التونسيين جريمة بحق إستقلال القضاء فى تونس

يعرب المركز العربى لإستقلال القضاء والمحاماة عن إدانته بأشد العبارات للحكم الصادر بحق القاضى الجليل أنس الحمادى رئيس جمعية القضاة التونسيين من المحكمة الإبتدائية فى تونس بتاريخ 6 ابريل 2026، والذى قضى بحبسه سنة على خلفية ممارسته لحقه كقاضى فى القضايا العامة والدفاع عن إستقلال القضاء فى تونس . ويرى المركز أن السيد الحمادى قد مارس حقه المشروع كقاضى ورئيس جمعية القضاة التونسيين فى الدفاع عن إستقلال القضاء وحماية أعضائه ضد تدخل السلطة التنفيذية فى أعمال السلطة القضائية التونسية وفقا لأحكام مبادئ الأمم المتحدة لإستقلال السلطة القضائية الصادرة عن الجمعية العامة للأمم المتحدة فى ديسمبر 1985 ، والتى تنص فى المواد 7 و8 من الإعلان على أنه يحق لأعضاء السلطة القضائية كغيرهم من المواطنين التمتع بحرية التعبير والإعتقاد وتكوين الجمعيات والتجمع ، كما للقضاة الحق فى حرية تكوين جمعيات القضاة أو غيرها من المنظمات لتمثيل مصالحهم والنهوض بتدريبهم المهنى وحماية إستقلالهم .

🟥 Approval of law permitting ex*****on of Palestinian prisoners violates international humanitarian law, requires consent of Palestinian National Authority

The Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP) strongly condemns the issuance by the Israeli parliament of a law permitting the application of the death penalty to Palestinian prisoners under the authority of the occupation, notwithstanding the abolition of the death penalty for murder in Israel since 1954. This constitutes a clear violation of the provisions of the Geneva Convention relative to the Treatment of Prisoners of War, which prohibits the conviction of any prisoner of war for an act that is not expressly prohibited by the law of the detaining power. Moreover, prisoners of war in situations of occupation are entitled to the protections afforded by international humanitarian law governing the treatment of detainees in times of war.

🟥 إقرار قانون إعدام الأسرى الفلسطينيين إنتهاك لأحكام القانون الدولى الإنسانى ويستوجب موافقة السلطة الوطنية الفلسطينية

يدين المركز العربى لاستقلال القضاء والمحاماة بأشد العبارات ، إصدار البرلمان الإسرائيلى لقانون يسمح بتطبيق عقوبة الإعدام على الأسرى الفلسطينيين الخاضعين لسلطة الاحتلال ، رغم إلغاء عقوبة الإعدام فى جرائم القتل فى إسرائيل منذ عام 1954 . وهوالأمر الذى يمثل انتهاكا واضحا لأحكام إتفاقية جنيف لحماية أسرى الحرب التى تحظر إدانة أى أسير حرب لفعل لا يحظره صراحة قانون الدولة الحاجزة . فضلا عن تمتع أسرى الحرب فى حالات الاحتلال بحماية القانون الدولى الانسانى الذى ينظم معاملة الأسرى فى حالات الحرب .
ويشير المركز إلى أن سلطة الاحتلال التى لاتملك توقيع عقوبة الإعدام على أى مخالفة إلا بموافقة الدولة التى يتبعها الأسرى ، حيث تنص المادة 100 من اتفاقية جنيف الثالثة على أنه ( يجب تبليغ أسرى الحرب والدول الحامية فى أقرب وقت ممكن بالمخالفات التى تستوجب عقوبة الإعدام طبقا لقوانين الدولة الحاجزة ، ولا يجوز فيما بعد تقرير عقوبة الاعدام عن أى مخالفة إلا بموافقة الدولة التى يتبعها الأسرى)وهى السلطة الوطنية الفلسطنية .

🟥 ACIJLP calls on Arab Gulf states to expedite accession to the International Criminal Court

The Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP), together with the Arab Coalition for the International Criminal Court, is monitoring the US-Israel-Iran war and the accompanying military operations that have affected most of the Arab Gulf states (Qatar, Kuwait, the Kingdom of Saudi Arabia, Bahrain, Oman, and the United Arab Emirates). These military operations have resulted in acts that may rise to the level of the crime of aggression, war crimes, and crimes against humanity, in accordance with Articles 5, 7, 8, and 8 bis (A) of the Rome Statute of the International Criminal Court. The ACIJLP considers that ratification by the Arab Gulf states of the Rome Statute establishing the International Criminal Court would grant them the right to request investigations and prosecutions in relation to the military operations to which they are subjected. This right is accorded to States Parties to the Court where the alleged crimes have occurred after 2002, in line with the Court’s temporal jurisdiction.
