Working while partially sick? Germany may be changing the rules.

A major reform of German employment law is expected to introduce the concept of partial incapacity for work from 2027.

Instead of the current “all or nothing” approach, employees could be certified as being partially unable to work (for example, 25%, 50%, or 75%), allowing them to continue working to a limited extent where medically appropriate.

The aim is to support a gradual return to work, reduce long-term absences, and better reflect the reality that many illnesses do not completely prevent someone from working.

However, this does not mean that employees will automatically be required to work while ill. The proposed model is intended to be voluntary and will depend on medical assessment as well as whether the specific job is suitable for partial work.

If implemented, this would mark one of the most significant changes to German sick leave rules in years.

Every lawyer has a story, and this is a part of mine.

I was born in Iran, grew up in Germany and also lived in England. During my studies, I completed a minor in East European and Eurasian Studies, spent time in Moscow and learned Russian. Those experiences taught me that understanding different legal systems always starts with understanding people and cultures.

Before founding my own law firm, I worked at the Chamber of Industry and Commerce (IHK) in the field of anti-money laundering. Today, I advise international clients in business immigration, employment law and corporate law.

Being married into an Arab family has enriched my perspective even further. Living between cultures has shaped not only who I am as a person, but also how I approach my work as a lawyer.

I believe that every client deserves more than legal expertise. They deserve someone who understands different cultures, communicates with empathy and thinks beyond borders.

Many business owners ask for contracts that are as short and simple as possible. While that may save a little time today, it can create much bigger problems in the future.

A well drafted contract is not long because lawyers like to write more. It is long because it covers situations that no one is thinking about today but that may become critical later.

The clearer responsibilities, rights, and procedures are defined, the lower the risk of misunderstandings, costly disputes, and legal proceedings.

A good contract is not about the number of pages. It is about protecting your business when it matters most.

The coalition has announced several proposed changes to German employment law. Among them are stricter rules for sick leave certificates, the possibility of extending fixed-term employment contracts without an objective reason to up to four years, and tax-free overtime pay.

These proposals could have a significant impact on both employers and employees. However, it’s important to remember that they are not law yet. We’ll have to wait and see which of these proposals are ultimately implemented.

When applying for an extension of a residence permit for self-employment in Germany, the immigration authorities will typically assess whether the business has been operated successfully.
