Why Legal Documents Matter - Before and After Migration to Germany?

Legal documents are official papers issued by government authorities that prove your identity and civil status.

In the context of migration to Germany, legal documents demonstrate your identity, nationality, family relationships, and marital status, and they must be authentic, registered, and often translated for acceptance by German authorities.

Legal Documents & Relevant Laws:

NIC & Passport.

Birth & Marriage Certificate(including Nikkah Nama).

Divorce & Death Certificates.

Before Migration:
Needed for all kind of visa applications especially family reunion visa.

After Migration:
Required for applications for Permanent Residency and citizenship, registering marriages, enrolling children in school etc.

Update in Family Reunion Visa (FRV) for Germany:

The German Embassy (GE) has now shifted the FRV process to an online system since 15.01.26. The applications and documents are being submitted digitally instead of physically.

Some important practical points for applicants:

1. There is no separate space to upload your spouse’s Birth Registration Certificate (BRC) therefore create one single PDF containing both your BRC‘s.

2. There is no separate section for Nikahnama / proof of relationship therefore creat one combined PDF including:

- Marriage Registration Certificate (MRC)
- Nikahnama + English or German translation
- Screenshots of communication
- Wedding photos
- Bank Transactions or any other evidence

3. Upload your health insurance PDF under “Other Documents”.

You can edit your forms and documents before final submission, but once you submit the application, you can only view it, no further changes are possible. So be very cautious while filling in the forms and uploading documents.

Overall, the system appears more streamlined, and hopefully this online transition will reduce processing times once the initial confusion settles.

Whether a woman can file Khula through Power of Attorney ?

A woman can take the decree of divorce through power of attorney in Pakistan, but there are some conditions and procedures that she must follow. Here are some of the main points;

A woman can only exercise the right of divorce if the same is granted to her in her marriage contract or Nikkha Naama. If not, she has to file for khula before the family courts of law to obtain judicial divorce.

A woman can appoint a power of attorney to act on her behalf in matters of divorce or khula, but she must be physically present at the time of ex*****on of the power of attorney and must sign it in front of two witnesses.

A woman can also apply for an online power of attorney through the NADRA portal, which is a digital process for issuance of power of attorney for overseas Pakistanis.

She must have a valid NICOP, CNIC, or POC, and must upload her biometrics and pay the required fee.

She must also undergo an online video interview with the consular officer to determine the final decision on the case.

A woman who wants to give power of attorney to someone else must choose the concerned Pakistan foreign mission (embassy/high commission/consulate) when applying for the digital power of attorney. Failure to do so might route the application to the wrong mission and could result in rejection.

A woman who is a foreigner must have her documents attested from her country’s state department/ministry of foreign affairs before visiting the concerned Pakistan mission abroad.
