Alliuris Summer School 2019

This year, the International Summer School took place in Madrid. From the 2nd to the 6th of July young lawyers from Europe, Asia and the Americas attended the academy hosted by the law firm 4 | 5 | 3, Spanish member of our group.
Current topics such as Security Data Breaches and big data in the law industry were covered. Moreover, the participants also participated in workshops about taxation and legal English skills. The balance between the academic work and social events was perfect. The participants enjoyed the sunny days to go sightseeing and get to know each other better.

General Meeting in Brussels

Last weekend, June 06-08, the general meeting took place in Brussels and was organized by our partner law firm Clerens Partners. The group talked about current developments in Belgium, the Brexit as well as one year GDPR. A well balanced free time program completed the meeting. We thank our hosts for the great meeting!

The digital technology of artificial intelligence (AI) rapidly gains grounds in many areas of business, politics and society. The fast and far reaching capacities of AI supported instruments often change the game significantly – and raise new legal questions. When machines take their own autonomous decisions – who then shall be the parties to a contract and who is liable for damages? Can AP systems or their creations be protected under IP law? And what is the responsibility and liability of the management using or not AI in decision making processes? Ulrich Herfurth gave a presentation on AI and law that reflected the current stage of the legal and ethical discussion.

Tax Law in the USA

The US have implemented recent changes in tax law, explained Ian Shane, tax expert of Michelman & Robinson in the Alliuris Conference in L.A. . The US Tax Code is moving away from a worldwide tax system in favour of a territorial system. The new rules are similar to many European participation exemption regimes but amount to just a dividend received reduction (DRD).

Besides the federal income tax many U.S. states and cities also charge local corporate income tax. This is deductible against federal corporate income tax. But only corporate shareholders receive the DRD, and they must hold a 10%+ interest in the foreign paying corporation and have held those shares for more than 365 days after the shares become ex-dividend. For qualifying shareholders receiving qualifying dividends the result is 0% tax on dividends received. Only real dividends are considered to be a Qualifying Dividend, while deemed dividends under Anti Avoidance provisions of the Tax Code or foreign branch profits will not qualify.
