After extensive discussion by the European Patent Office, in which we were also involved as part of our engagement with the FICPI, the final version of the revised 𝙍𝙪𝙡𝙚𝙨 𝙤𝙛 𝙋𝙧𝙤𝙘𝙚𝙙𝙪𝙧𝙚 𝙤𝙛 𝙩𝙝𝙚 𝘽𝙤𝙖𝙧𝙙𝙨 𝙤𝙛 𝘼𝙥𝙥𝙚𝙖𝙡 𝙤𝙛 𝙩𝙝𝙚 𝙀𝙋𝙊 has now been adopted, which will enter into force on January 1, 2024.

With the aim of supporting the production and development of semiconductor chips, the United States Patent and Trademark Office (USPTO) launched a pilot program to promote semiconductor innovations on 1 December 2023.

The aim of this program is to accelerate the examination of qualified patents and to bring semiconductor technologies to market more quickly in order to reduce the USA's dependence on external suppliers.

The pilot program will be discontinued after the acceptance of 1000 eligible applications or no later than 2 December 2024 🚀.

In the above-mentioned decision, the Enlarged Board of Appeal dealt with the question of the extent to which evidence submitted after the filing date can be used to substantiate inventive step.

In the grant procedure before the European Patent Office, it is generally possible to submit evidence, in particular in the form of experimental test data, which can be used to credibly demonstrate an advantageous technical effect over the prior art found - and to substantiate an inventive step.

In recent years, however, it seems to have become successively more difficult to submit such data to prove inventive step. Moreover, an achievable technical effect cannot be credibly demonstrated solely with subsequently submitted data.

The description of a feature in the prior art with an alternative or contrary embodiment to the claimed patent in dispute cannot establish an inventive step in general if the embodiment is described merely as an exemplary embodiment.
Application DE 10 2018 221 678.9 "Dekorformteil” (“Decorative moulded part" was received by the German Patent and Trade Mark Office on 13 December 2018 and was refused by the Examining Division for Class B60R by decision of 25 March 2020.
The patent applicant's appeal, which was received by the German Patent and Trade Mark Office on 30 April 2020, is directed against this decision, which was served on her on 30 March 2020. In its statement of grounds of appeal of 24 August 2020, the appellant disagrees with the Examining Section's statements in the rejection decision.

In opposition proceedings concerning the application for the EU figurative mark KAUFDAS ONLINE, the 2nd Chamber of the ECJ ruled that the decision of the EUIPO that this mark was too similar to the earlier EU word mark "KAUFLAND" and the earlier EU figurative mark "Kaufland" pursuant to Art. 8 I b) of the EU Trade Mark Regulation and should therefore be cancelled was upheld, thus dismissing the appeal of Kaufdas online against the decision of the EUIPO.

In the proceedings, it played a role in particular that the trade marks at issue are EU trade marks and the language knowledge of the consumers is relevant. Thus, the assessment of the likelihood of confusion must in principle be based on the perception of the two signs by the relevant consumers within the entire European Union.

One of the fastest growing fields of researchis that which focusses on gene-edited crops or organisms. These are crops or organisms that have had their genomes edited in order to make changes to the plant or organism at the DNA level. Such changes can include the addition, altering or removal of DNA from the plant or organism genome.
The European Commission recently published proposals to change the legislation governing such changes. Currently, the rules regarding “new genomic techniques” or NGTs are rather restrictive. Under the new proposals, gene-edited crops which contain changes to existing DNA within the organism and which can be obtained via conventional breeding methods will be subject to much lighter regulation on the European level.
