Contested divorce in Cyprus: what the traditional procedure involves

Not every marriage ends by agreement. When one spouse withholds consent, or when custody, maintenance and property remain in dispute, the contested procedure before the Family Court is the route that stays open.

Where the marriage was religious, notice must first be given to the competent Bishop and six weeks must pass before filing; for civil marriages the application goes directly to the District Family Court.

Timing follows the dispute. If the disagreement concerns only the ground for divorce, 6 to 12 months is realistic. If property division, parental responsibility or maintenance are litigated alongside it, 18 to 24 months or more.

Two deadlines are easy to lose sight of: claims for the division of matrimonial property must be filed within 3 years of the divorce becoming final, and interim relief, such as exclusive use of the family home or urgent maintenance, is usually worth seeking early rather than at trial.

Picking a company name feels easy, until you find out it is already taken.

Cyprus law sets out strict rules on what a company name can and cannot contain: it must be distinct from existing names, and certain words are restricted unless you have approval from the relevant authority (Central Bank, CySEC, Ministry of Education, and others, depending on the word).

Most people only find this out after the Registrar rejects their application.

Το Radio Equipment Directive δεν μιλά πια για ραδιοσυχνότητες. Μιλά για cybersecurity. Κάθε smartphone, router, wearable, ακόμα και παιδικό παιχνίδι που στέλνει δεδομένα πρέπει τώρα να αποδεικνύει ότι είναι ασφαλές by design. Ακούγεται λογικό. Αλλά υπάρχει μια σκοτεινή πλευρά.

Οι ίδιοι κανόνες που προστατεύουν από botnets μπορούν να χρησιμοποιηθούν για να κλειδώσουν τις συσκευές σας. Η Samsung κλείδωσε το bootloader λίγες μέρες πριν την προθεσμία. Η Google; Παρέμενε σιωπηλή. Η Fairphone; Εξηγήσε ότι είναι υπερέχει η ελευθερία του χρήστη. Ο ίδιος νόμος, τρεις διαφορετικές ερμηνείες.

Το RED ήθελε ασφάλεια. Κινδυνεύει να δώσει vendor lock-in. Και η αντίφαση γίνεται πιο έντονη και πιο εσωστρεφή: η ΕΕ θέλει να επισκευάζετε τις συσκευές σας και να τις κρατάτε περισσότερα χρόνια (Right to Repair), ενώ ταυτόχρονα ενθαρρύνει να κλειδωθούν για λόγους ασφαλείας. Μια αργή συσκευή ανέχετε με λίγή υπομονή και tweaks, μια συσκευή που δεν είναι συμβατή είναι κυριολεκτικά άχρηστη.

Πιο Πρακτικά; Αν η συσκευή επιτρέπει εγκατάσταση τρίτου software, το self-declaration δεν αρκεί πλέον. Ο κατασκευαστής χρειάζεται εξωτερική πιστοποίηση. Χρειάζεται €50K–€150K. Κεφάλαια τα οποία είναι pocket money για ένα conglomerate. Είναι θανατική ποινή για έναν indie developer που θέλει να φτιάξει custom hardware ή να πουλήσει ένα smartphone με bare-metal εγκατάσταση για GrapheneOS.

Το RED σχεδιάστηκε για να σταματήσει τα φθηνά temu gadget που γίνονταν botnet και οπλά τρομοκρατών. Καταλήγει όμως να φρενάρει την καινοτομία στο πιο δημιουργικό τομέα της αγοράς. Η ασφάλεια είναι σημαντική. Αλλά όταν οι κανόνες τιμωρούν το opensource και το MVP mindset, κάτι πήγε στραβά.

Το Radio Equipment Directive δεν επιβάλλει κλειδωμένα bootloaders. Αλλά η αοριστία του ενθαρρύνει στους κατασκευαστές να επιλέξουν τη σκληρότερη ερμηνεία, και να την συσκευάσουν ως «συμμόρφωση».

Όταν ο ίδιος κανόνας παράγει ελευθερία σε μία εταιρεία και «κλειδώματα» σε άλλη, το πρόβλημα δεν είναι ο τεχνοκρατισμός και/ή ο πατερναλισμός. Είναι η ασάφεια, το λεξιλόγιο και το προπαρασκευαστικό lobbying. Είναι ο νομοθέτης.

Μπορείς να χάσεις το σπίτι σου ακόμα κι αν η τράπεζα δεν αποδεικνύει πόσα της χρωστάς; Η απάντηση είναι: ναι.

Το Ανώτατο Δικαστήριο το επιβεβαίωσε το 2025 στην υπόθεση Μιτσηγιώργη. Η υποθήκη λειτουργεί ως αυτόνομη εξασφάλιση, ανεξάρτητα από το αν αποδεικνύεται το προσωπικό χρέος.

Αποδείξεις για το πραγματικό υπόλοιπο; Ίσως δεν χρειάζονται. Το έγγραφο της υποθήκης μιλάει από μόνο του.

Αυτό σημαίνει ότι η μάχη δεν κερδίζεται στο "πόσα χρωστάω", αλλά στις διαδικαστικές πλημμέλειες: επίδοση, προθεσμίες, καταχρηστικοί όροι κλ.π.

Προσπαθείς να στείλεις πολυσέλιδα σημειώματα, δικόγραφα ή γενικά σκαναρισμένα έγγραφα, τα σπας σε πολλαπλά emails, κι όμως επιστρέφονται με το ενοχλητικό «Message too large for the recipient»; Σε messengers μπερδεύονται οι σελίδες, χαλάει ο προσανατολισμός (rotation) και μετά από λίγο καιρό χάνονται;

Μπορείς να «κατέχεις» αρχεία που δεν ξέρεις καν ότι υπάρχουν στο κινητό σου;

Τα λεγόμενα cache files αποθηκεύονται αυτόματα από τον browser, το OS και τις άλλες εφαρμογές. Δεν τα «κατεβάζεις», δεν τα βλέπεις, δεν τα ελέγχεις… κι όμως βρίσκονται στη συσκευή σου, έστω και προσωρινά.

Σε ποινικές υποθέσεις, η συζήτηση έχει ήδη ξεκινήσει: μετρά αυτό ως «κατοχή» παράνομου υλικού;

Τα κυπριακά δικαστήρια έχουν τονίσει ότι πρέπει να ξεχωρίζουμε τη θέαση από τη γνώση και έλεγχο ενός τοπικού αρχείου. Χωρίς γνώση & έλεγχο, δεν υπάρχει νομική «κατοχή».

👉 Από το Telegram & το Discord μέχρι την απλή πλοήγηση: οι συσκευές δημιουργούν αυτόματα ψηφιακά ίχνη. Η ποινική ευθύνη όμως πρέπει να βασίζεται στη βούληση, όχι στη μηχανική αυτοματοποίηση.

Alarming Developments in Cyprus' Approach to Human Trafficking

Recent reports reveal a concerning shift in Cyprus' handling of human trafficking cases. According to Council of Europe assessments, and Turkey now stand alone in Europe in relegating to migration authorities rather than justice or law enforcement agencies.

This move represents a significant policy reversal. In 2019, Cyprus drafted legislation to align with international norms by transferring human trafficking responsibilities from the Interior Ministry to the Justice Ministry. Shockingly, not only was this progressive bill abandoned, but Cyprus has now taken a step backward by placing these critical matters under the newly formed Deputy Ministry of Migration.
