'In that regard, the Court notes that, where a term of a consumer contract relating to the main subject-matter of that contract must be declared unfair, the directive does not preclude a national court from restoring the parties to the contract to the situation they would have been in if that contract had not been concluded. However, if that is not possible, it is for that court to ensure that the consumer is ultimately restored to the situation that he or she would have been in if the unfair term had never existed'

Η απόφαση της πλειοψηφίας είναι πάρα πολύ ενδιαφέρουσα και εμπεριστατωμένη και πραγματεύεται με ένα ευρύ φάσμα του δικαίου. Πραγματεύεται με ζητήματα δεκτότητας εξ ακοής μαρτυρίας (ειδικότερα με τη μαρτυρία ενός γιατρού που είδε τη κατάσταση της εφεσείουσας κατά τις πρωινές ώρες μετά τον καταγγελλόμενο βιασμό), αυτοενισχυτικών δηλώσεων, μαρτυρία εμπειρογνωμόνων και κενά στη μαρτυρία τους και το σκοπό της προσκόμισης μαρτυρίας εμπειρογνώμονα της υπεράσπισης μέσα στο ευρύτερο πλαίσιο του βάρους απόδειξης που έχει η Κ.Α. να αποδείξει την κατηγορία.

We are excited to take part in the online seminars for the new Civil Procedure Rules. The new Civil Procedure Rules significantly change the current rules in place. The new rules form part of the efforts underway for the reform of the administration of justice.

The rules are expected to come into force in the near future and remain to be tested in practice. As a way of an example of a positive change, among others, is the scheduling of hearing dates as per rule 37.6:

''The provision in rule 37.6 is also indicative, according to which the dates of the hearing are consecutive, i.e. “day in - day out”, which of course presupposes a proper planning of the hearing of the case between the lawyers and the court.

The current practice of setting a case for a hearing is to have one day allocated every 2-3 months and if the hearing needs to continue over 10-15 days, this results sometimes in the continuation of hearings over two or three years. Χαιρετίζουμε την πρόσφατη απόφαση της Π.Ε.Δ. Λευκωσίας κας. Στ. Χριστοδουλίδου Μέσσιου να κρίνει ως καταχρηστικές, ρήτρες σε σύμβαση δανείου χρηματοπιστωτικού ιδρύματος στην Κύπρο.

Οι καταχρηστικές ρήτρες μας αφορούν όλους, δικαστές, δικηγόρους, δικηγορικούς υπαλλήλους, τραπεζικούς υπαλλήλους, και τον κάθε ένα πολίτη της Κυπριακής Δημοκρατίας, ως κράτος μέλος της Ε.Ε.

Η δικαστική αυτή απόφαση, που υιοθετεί ουσιαστικά τις θέσεις της Υπηρεσίας Προστασίας Καταναλωτή, σίγουρα αναγνωρίζει την ανάγκη επαρκούς προστασίας των καταναλωτών σε προδιατυπωμένες συμβάσεις που παρουσιάζει ο προμηθευτής για υπογραφή. Η απόφαση αποτελεί ένα πολύ χρήσιμο εργαλείο στο αγώνα για τη δικαίωση των καταναλωτών.

Οι δικαστές της χώρας, όλων των επιπέδων, οφείλουν να αναγνωρίζουν αυτόν τον αγώνα καθότι αφορά και τους ίδιους.

Ποιος δεν έχει δάνειο σε χρηματοπιστωτικό ίδρυμα, ποιος δεν αγοράζει ένα αυτόκίνητο, μια ακίνητη ιδιοκτησία, μια ηλεκτρονική συσκευή, ένα ταξίδι στο εξωτερικό.

Όλοι οφείλουμε να αναγνωρίζουμε αυτό τον αγώνα.

The United Kingdom withdrew from the European Union on 31/1/2020 on the basis of the Withdrawal Agreement, which provides for a transition period that is to end on 31/12/2020. Until that date, the Union law on VAT is to be applicable to and in the United Kingdom. As from 1/1/2021, the Union law on VAT is to no longer apply to or in the United Kingdom.
