New building restrictions in Nosara to protect the famous sea turtle arribadas. But here’s the catch: they don’t apply where the arribadas actually happen.

A foreign investor lost a six-year legal battle against the Nosara Civic Association and the Municipality of Nicoya. The Supreme Court made the regulation final last week.

What the regulation imposes within a 5 km buffer zone around the Ostional National Wildlife Refuge:

- Maximum building coverage: 50% of the lot
- Height limits: 9 meters in the first kilometer, 12 meters beyond
- Exterior lighting: invisible from the beach, max 50W incandescent or 8W LED
- Mandatory wastewater treatment, no artisanal septic tanks

The catch: the rules only apply to the canton of Nicoya. Playa Ostional itself sits in the canton of Santa Cruz, where the massive arribadas actually occur. Santa Cruz has no equivalent regulation.

Transitional exception: projects already in process at SETENA or CFIA before 28 February 2020 are exempt, but owners have 6 months to adapt.
