Swiss Child Protection Authorities (KESB) can order guardianship under Swiss Child and Adult Protection Law if the welfare of a child is at risk, e.g. because the parents are arguing violently or neglecting childcare. However, child protection measures can drastically change family life. The situation is similar when KESB appoints a guardian for older people. In such cases, the guardian intervenes in financial, personal, or organizational matters. This means that those affected may lose their say and autonomy in everyday life.
Once KESB has ordered measures, they are difficult to challenge or even be lifted. Many of those affected feel that this is a loss of self-determination and autonomy. When KESB opens proceedings, many questions arise: Can child and adult protection measures be prevented? Do those affected have a say in the proceedings and the right to be heard? Those who know their rights and obligations in the proceedings and provide evidence can avoid unnecessary restrictions in addition to high procedural costs and attorney's fees.
