Employment Law | Mobbing
We spend long hours at work and our environment necessarily impacts our well-being.
The word mobbing is used in cases of psychological harassement in the workplace.
According to the Swiss Federal Tribunal, it is a pattern of hostile words or actions, frequently repeated over a long period of time, by which one or more individuals seek to isolate, marginalise or even exclude a person in the workplace. It may involve acts which, taken individually, appear to be bearable but which, taken as a whole, may gravely undermine and degrade a person (Swiss Federal Tribunal, 8C_398/2016 of 17.05.2017 reasoning 4.1.1).
Employers have a duty to implement appropriate measures for the protection of workers' health and to prevent mobbing situations (Art. 328 CO, Art. 6 LTr, Art. 2 para. 1 OLT 3). It may consist of training managers and employees in conflict resolution, the establishment of internal guidelines, organisational measures, the intervention of a mediators or a trusted person.
