Many of the legal questions affecting Indigenous Nations today did not begin with the latest court decision or news headline. They are connected to a much longer history of treaties, Crown-Indigenous relations, assertions of sovereignty and the laws and governance systems that existed long before Canada.

That history is not background information. It is part of understanding why the legal questions exist in the first place.

Curiosity is a better starting point than certainty. Before reaching a conclusion, it is worth asking: What history shaped this issue? What legal relationships are involved? Whose perspective may be missing from the discussion?

For Aaron Christoff (Partner), a Nehiyaw (Cree) citizen of Saulteau First Nations ( Treaty 8 ), understanding Indigenous history is essential to understanding many of the relationships and issues that continue to shape Canada today.

That understanding starts with curiosity, asking questions, learning about the histories of Indigenous Nations and their relationships with the Crown, and recognizing how treaties, laws, and colonial policies continue to have present-day impacts.

Creating space for that learning can lead to more informed conversations about Indigenous rights, reconciliation, and the path forward.

Hands-on experience can change the way you understand the practice of law.

For Adam (Articling Student), being involved in a recent trial meant seeing firsthand everything that happens beyond the decisions studied in law school, from preparation and last-minute developments to the work required to advocate effectively for a client.

Trust is an important part of any lawyer-client relationship, but for many Indigenous people, that relationship exists within a much broader historical context.

As a member of Shawanaga First Nation, Reilly (Lawyer) brings her own connection to Indigenous community and identity to the way she approaches this work. She recognizes that generations of colonial laws, policies, and experiences with Canadian institutions have contributed to distrust that cannot simply be set aside when legal support is needed.

For Reilly, building meaningful relationships means approaching clients with compassion, understanding where that distrust comes from, and recognizing that trust may take time to develop.

The duty to consult is an important part of the relationship between the Crown and Indigenous Nations in Canada.

It can arise when the Crown is considering decisions that may adversely affect asserted or established Aboriginal or Treaty rights. What meaningful consultation looks like will depend on the circumstances, including the strength of the rights claim and the seriousness of the potential impact.

At its core, consultation requires more than simply informing a Nation that a decision is being considered. It requires meaningful engagement with the rights and interests at stake.
