- WILLS. WHY DO I NEED ONE? -

Having a will is arguably one of the most important things you can do, regardless of the size of your estate:

1. Children’s Guardian: if you have children that are minors, you may want to express your wishes as to who they should be taken care of by. Though the court makes the ultimate decision as to guardianship, they take into consideration wishes expressed in a will. In addition to guardianship, you may also wish that funds for the benefit of your minor child be transferred to their guardian which would be difficult to do without a will.

2. Managing your Estate: a Will would ensure that your estate and possessions would be managed and distributed by only those that you list as an executor. If you were to die without a will, you are unable to guarantee who will be taking care of your estate

3. Costly: without a Will, your next of kin may have to post a bond to manage the affairs of your estate.

4. The Law Can Change: if you die without a Will, your estate will be distributed in accordance with the law that is in force at the time of your death. The law that you may be relying on now, may change over time. A Will would ensure that your estate is divided up according to your wishes.
