New Condo Buyers: Donโ€™t Skip Your Certificate of Possession ๐Ÿšจ
The builder of 859 West Condos was hit with an HCRA administrative penalty for breaching Ontario new home construction rules โ€“ a reminder that builder compliance is not automatic. Administrative penalties are fines that can be imposed when builders donโ€™t follow the licensing and regulatory requirements tied to new home and condo projects.
๐Ÿ“„ Before occupancy closing, your certificate or letter of possession should match your agreement, permitted occupancy, and the promised timelines โ€“ if dates or terms look off, thatโ€™s a red flag. Starting occupancy (and fees) before things are properly authorized can leave you exposed while the builder faces only a monetary penalty.
โœ… Before you pick up keys:
โ€ข Get your occupancy documents in advance and actually read them.
โ€ข Check your builderโ€™s record on the Ontario Builder Directory for any HCRA actions.
โ€ข Have a real estate lawyer quickly review your certificate of possession and occupancy package.
