All of them I’ve spent practicing Family Law.

It’s been 10 years since I was called to the Ontario Bar…and so much has changed.

Thinking back on the past 10 years, I’m grateful for how far I’ve come in my practice, humbled by the trust my clients have placed in me, and honoured to have been part of so many individuals’ journeys, at what is often the most difficult time of their lives.

Family Law is known to be an emotionally tolling area of practice, but it’s also one of the most rewarding.

It’s been a minute since we last posted, but the last year has been far from quiet.

Over the last year, we said goodbye to some great people, and welcomed our new Law Clerk, Laura, to the office.

Our former clerk Kelsey has decided to pursue her law degree at Queen’s University following her mat leave, and we wish her all the best!

We have also been working on developing a new website (since December 😬) - Our clients have kept us busy, but we’re hoping to have that up soon!

We want to thank all of our clients, past and present, for your ongoing trust in us, your continual referrals of friends and family, and for including us on what is often a very difficult part of your journey.

The kind words and referrals we’ve received from past clients are truly what keep us going, and we never take that for granted 🙏

❓Did You Know❓

The changes coming into effect today mark the first major overhaul to the federal Divorce Act since 1986😱

The new provisions are also largely mirrored in the Ontario Children’s Law Reform Act, which deals with unmarried spouses.

⚖️The new law:

✅ Does away with outdated terms of “custody” and “access”, which actually have their roots in the concept of “children as property”
✅ Puts a focus on “the best interests of the child” and provides an expanded criteria for what that means
✅ Promotes alternative dispute resolution, and places a duty on divorcing spouses to consider ADR, including ... ✨Collaborative Law!! ✨(Ok, we’re just a little excited about that 🤓)
✅ Provides an expansive definition of “family violence” and require the court to consider the impact of family violence in any parenting order
✅ Creates a new legal framework for relocation of a child (ie: moving a child to a different jurisdiction)
✅ Expands the powers of support enforcement agencies

This law will affect parties who are already before the court, and those who are starting an application after today’s date.

❓Can I JUST get a Divorce❓

The short answer is ➡️ ➡️➡️ Maybe.

✅ If you and your spouse have been separated for a period of one year or more, and have already dealt with the issues arising from your marriage (ie: parenting schedule, custody, child support, property) by way of a separation agreement, you can file what’s commonly referred to as an “uncontested divorce”.

❎ However, a judge will not grant a divorce if he/she is not satisfied that there are proper provisions in place for the care and support of the children.

You should also know that filing for a divorce before resolving property issues can limit the amount of time you have to make a claim for property division, and may limit other rights you have in the future. For that reason, we always recommend having at least a consultation with a to understand your rights, before moving forward with a divorce.

❇️Ontario’s New Stay-at-Home Order❇️

Today, announced a Stay-at-Home order, beginning this Thursday, January 14th.

What does this mean for children who live in more than one home?

Since March 2020, we have received a significant amount of guidance from the Ontario Courts on determining how the requirement to limit contact to your own household should be balanced with a child’s right to share time with each parent.

Here is a summary of what the Courts have said on this issue:

✅ Existing parenting arrangements and schedules should continue (ensuring that COVID-19 precautions are being complied with)

✅ In some cases, a custodial or access parent may need to give up some time with their child, for example, if the other parent or child has been exposed to the virus and is required to self-isolate for 14 days.

✅ Denials of access and “self-help measures” will not be tolerated by the court.

✅ Even in cases where a child is immunocompromised, a court will generally not deny access, where the access parent is taking all necessary precautions and following health guidelines.

✅A court may question the parent’s judgment, and restrict in person contact with the child if COVID-19 guidelines are not followed

This guidance was wonderfully summarized by the Honourable Justice Pazaratz, who said:

“… we are going to have to put our lives "on hold" until COVID-19 is resolved. But children's lives - and vitally important family relationships - cannot be placed "on hold" indefinitely without risking serious emotional harm and upset.

A blanket policy that children should never leave their primary residence - even to visit their other parent - is inconsistent with a comprehensive analysis of the best interests of the child.

In troubling and disorienting times, children need the love, guidance and emotional support of both parents, now more than ever.”
