Did you know that if ever you have a question about the law; you can go to caij.qc.ca. It's completely free! If ever you want to find jurisprudence you can do that for free also. There are also texts of law (legislation) which are annotated and give you access to jurisprudence (judgements) directly related to the question or article of law you are researching.CAIJ has partnered up with CanLII and brings you free jurisprudence. When you are looking for an answer during your research just type in key words into the search box on either site and press enter. The results will load up and you will see the most relevant jurisprudence related to your search. You can filter the results using various setting. The order of results by default is set for the most pertinent results to show first.
All of the Canadian and Quebec courts have websites which house a multitude of documents, forms and tremendous amounts of valuable information on the inner workings of the Court system.
What is a plumitif?
A plumitif is two things. It is essentially a computer database which is completely seperate from any Internet source. This information is uploaded to another database which is located on the Internet.
The information contained in this database contains the descriptions of the documents which are contained in the court dockets at the courthouse (e.g.: procedures, notices, declarations, notifications, expert reports, subpoena (Sapeena* (*phonetic))
The computer and the informations sheets generated are both referred to as the plumitif. “Let me go check the plumitif
I'll use the plumitif at the courthouse to get the court file number.”
Did you know, the courthouse plumitif is free. All the information is public and searchable during opening hours. For professionals there’s a site called SOQUIJ.qc.ca which can accès the online version of the plumitif.
Did you also know that you can search to see if a professional has been sanctioned before doing business with them. Just go to SOQUIJ for the public and search using the name of business name of the professional in question. Next time I got to to see a new dentist I know where I’m going to check first.
Did you know that the main tools used in a civil dispute are the Civil Code of Québec and the Civil Code of Procedure. These two codes together house a huge amount of resources. They are also both bilingual. These codes are also annotated; If accessed from the links provided above you also have access to the jurisprudence associated to each article of the codes. Thisn allows you to hone in on the articles being researched to better understand their history of interpretation by the courts.
Another really awesome resource is OBITER 2 This is a treasure trove of resources for legal practitioners. Go to this site to find links to other really useful online legal tools like:
Legal and governmental resources; Legislative resources; Jurisprudential resources;
Doctrinal resources;
Resources of general interest to the public (consumer protection agency, normes du travail (CNESST));
Government registry offices (Land registry, moveable rights registry, enterprise registrar); And so much more, just go take a look!
