Executors: is more always better?
A recent BC Supreme Court case (Phagura v Frenette) highlights how appointing multiple family members as executors can sometimes lead to conflict and delay in administering an estate. In this recent case, disagreements between siblings ultimately resulted in the court appointing an independent administrator to move things forward.
Many people choose to name more than one child—or even multiple family members—as executors with the best of intentions, often to keep things fair and inclusive. But in practice, more decision-makers can sometimes mean more room for disagreement, delays, and added stress for everyone involved.
When preparing or updating your Will, it’s worth carefully considering whether a single executor, or a neutral third party, might better support your wishes and your family’s peace of mind.
Thoughtful planning today can help make things clearer and easier for the people you care about most.
