πŸ”₯ Major U.S. Immigration Shake-Up: What Applicants Need to Know

The Trump administration is taking a much more restrictive approach to U.S. immigration, with several significant developments announced or proposed:

πŸ”΄ Immigrant Visa Appointments Paused Worldwide
U.S. embassies and consulates are adjusting visa appointments as consular officers undergo new training focused on stricter screening of applicants, including potential reliance on U.S. public benefits.

πŸ”΄ B1/B2 Visas of Asylum Seekers Targeted
The U.S. State Department says it is moving to revoke visitor visas held by foreign nationals who entered the United States on B1/B2 visas and subsequently sought asylum. Reports indicate that up to 200,000 visas could be affected, although the number remains subject to change.

πŸ”΄ Proposed H-1B Fee of $103,265
The Department of Homeland Security has proposed an additional $103,265 fee for certain cap-subject H-1B petitions. This would be paid by the employer, and it would be in addition to existing H-1B filing costs.

⚠️ Importantly, the H-1B fee is a proposal, not a blanket fee for every H-1B worker. It would not automatically apply to all extensions, transfers, or cap-exempt petitions.

What does this mean for foreign nationals?

These developments demonstrate how quickly U.S. immigration policies can change and why applicants, employers and families should understand the specific rules that apply to their situation before making immigration decisions.

For individuals considering the U.S. B1/B2, H-1B or other immigration pathways, professional advice can be especially important during periods of significant policy changes.

πŸ“Œ Stay informed. Stay prepared. Make decisions based on the latest official rules.

Important TFWP Update: 90-Day Grace Period for LMIA Proof

Good news for temporary foreign workers in Canada!

The Government of Canada has extended the grace period from 60 days to 90 days for certain in-Canada work permit applications submitted while the employer’s LMIA is still being processed.

What does this mean?

Under concurrent processing, eligible workers can submit their TFWP work permit application before the employer receives the final LMIA decision.
The applicant now has up to 90 days to provide proof of a positive or neutral LMIA.

This can be especially helpful for workers whose current work permits are close to expiry and who are waiting for their employer’s LMIA.

Key requirements include:
βœ… Work permit expires in 2 weeks or less
βœ… Employer has submitted a complete LMIA application
βœ… LMIA decision is still pending
βœ… LMIA application was submitted early enough that a decision could reasonably have been expected

If eligible, this process can help workers maintain their legal ability to work in Canada through maintained status, while waiting for the LMIA decision.

⚠️ Important: This is not an automatic extension for everyone. Eligibility requirements must be carefully reviewed before submitting an application.
