It’s back! Congratulations to Kathleen O’Hara for her win in Cardona v Co-operators General Insurance Company. The Adjudicator determined that the Applicant had not met their burden in establishing entitlement to any pre- or post-104 week IRBs. The Adjudicator also drew an adverse inference based on the Applicant’s failure to produce relevant records.
