Is a Power Of Attorney Still Valid After Death?

A common question in estate planning is whether a Power of Attorney (POA) remains valid after the death of the person who granted it. The short answer is no. Once the individual passes away, the POA ends, and their last will and testament (if one exists) takes effect.

Real Life Example:
The seller of a home is elderly whose affairs are handled through a Power of Attorney. What would happen if the seller were to pass away prior to listing the home for sale, during the listing process or before closure of the sale? What happens next?

The POA becomes ineffective immediately. The property’s title can eventually transfer to the executor named in the will, but only after probate has been completed.

This process can take several months and cost thousands of dollars in probate fees. Until then, the property cannot be sold.

Understanding the Power of Attorney (POA)
A Power of Attorney is a legal document that grants an individual the authority to make decisions on behalf of someone else—typically regarding financial matters or medical care.

The POA becomes active when the person who granted it loses the mental capacity to make decisions.
Upon death, the POA is no longer in effect. At that point, the executor named in the will assumes responsibility for managing the deceased’s affairs.
If there is no will, a court-appointed administrator—typically the closest living relative—takes on the responsibility of settling the estate.

Other Situations Where a POA May End:
In addition to ending at death, a Power of Attorney can terminate under several other circumstances, such as:

The person who granted it revokes it.
The person who granted it files for bankruptcy.
The person who granted it becomes mentally incompetent (if it is not a durable POA).
A court terminates the POA.
The agent (the person granted POA authority) is convicted of a crime that caused harm to the grantor.

As of January 1, 2025, the new BC Home Flipping Tax has come into effect. This tax could impact property transactions if the property is sold within two years of ownership.

What is the BC Home Flipping Tax?

The BC Home Flipping Tax is a tax on the profit earned from selling property within a specific time frame. If you sell a property within 730 days (two years) of acquiring it, the tax may apply, unless an exemption is available.

Tax Rates and Timing:

Within 365 days: A 20% tax is applied to the net taxable income earned from the sale.
Days 366 to 730: The tax rate decreases gradually over the second year.
After 730 days: The tax no longer applies.
Example: If you purchased a taxable property on May 1, 2023 and sold the property on January 31, 2025, the profit you earn from the sale of the property would be taxable. If you decide not to sell the property until June 1, 2025, then the profit your earn from the sale would not be subject to the tax.
