Roberts v. Canada (Attorney General): Federal Inmates' COVID-19 Class Action Certified

This class-action lawsuit was brought on behalf of current and former federal inmates who allege that COVID-19 isolation measures caused significant psychological, physical, and emotional harm, and breached their rights under sections 7 and 12 of the Canadian Charter of Rights and Freedoms.

Avize Law Group's Patrick Dudding, Keith Schille, and Danielle Truant appeared before the BC Supreme Court seeking certification of the action.

In May 2025, the Court certified the lawsuit as a class proceeding, allowing the claims to move forward on behalf of the proposed class.

Certification does not determine liability. It allows the Court to consider the claims through a collective legal process.
