What does a personal injury lawyer actually do?

We believe in demystifying the legal process and putting that understanding back in our clients' hands. What a lawyer actually does usually has little to do with a courtroom.

Mostly, we work to understand what a fair valuation of your claim actually looks like. In a personal injury case, that can mean understanding medical records closely enough to know what they really mean for your recovery.

Ultimately we work towards the goal of helping you understand your own situation clearly enough to empower you to make your own decisions about it.

In BC, a spouse or child seeking to vary a will generally has 180 days from the date probate is granted to apply to the court.

Other estate claims can follow different timelines, depending on what's being disputed:

✔️Capacity challenges: questioning whether the will-maker had the mental capacity to make a valid will.

✔️Undue influence claims: raising concerns about pressure or manipulation affecting the will's terms.

✔️Executor disputes: concerns about how an estate is being administered or accounted for.

Understanding which timeline applies is often the first step toward understanding your options.

Is my injury serious enough to matter legally?

Feeling unsure is common, and there are a number of factors that shape how we perceive and report our own injuries. In fact, many people underreport what they've been through, sometimes due to:

✔️Embarrassment, or downplaying injuries to not be a burden.
✔️Distrust of systems that can feel built to wear people down rather than help.
✔️Financial barriers, worrying that the cost or time of pursuing a claim outweighs any benefit.
✔️Simply not knowing what qualifies, or how the process actually works.

What's important to remember: if an injury affects your well-being, your ability to earn income, or your ability to enjoy your life, it's serious enough to pursue.

Fair and just treatment shouldn't depend on who's watching.

That's the principle behind our national class action on behalf of federal inmates aged 50 and older, who allege they were abused and denied access to healthcare while in the custody of the Correctional Service of Canada (CSC). The Federal Court of Appeal has upheld certification of the case, allowing it to move forward on behalf of that class.

Avize's Patrick Dudding, Raj Sahota, and Danielle Toth have represented the plaintiff throughout, including before the Federal Court of Appeal.

CSC answers to the Minister of Public Safety, a role currently held by Gary Anandasangaree, once an internationally recognized human rights lawyer at the United Nations. That background makes this case worth watching closely.

How long do you have to make a personal injury claim?

In BC, the general rule is two years, but that clock doesn't always start on the day something happened. It often starts when the injury, or your ability to bring a claim, is reasonably discovered. A few things can affect that timeline, including:

✔️A diagnosis that came later than the initial incident.
✔️A slow-developing injury that wasn't obvious right away.
✔️Being a minor at the time the injury occurred.
✔️An incapacity that prevented you from acting sooner.
✔️Claims involving sexual assault or misconduct, which have no limitation period at all in BC.

Each of these is case specific, which is why it's worth asking the question even if you think the window may have closed.
