📌 Is it still possible to make a claim against ICBC with no-fault insurance?

A: For the most part, no. Under ICBC’s new Enhanced Care coverage system, there is limited ability to pursue legal action in relation to injuries suffered as a result of motor vehicle accidents, with the ability to sue restricted to situations where the responsible driver is charged with and convicted of specific criminal offences, or relating to the negligent design, maintenance or repair of a motor vehicle.

📌 Is hiring a lawyer beneficial to help navigate my ICBC claim?

A: Yes. It may be beneficial to determine if the circumstances of the motor vehicle accident that you were involved are within the exceptions that allow you to obtain compensation for your injuries. In addition, you may have entitlement to accident benefits including wage loss benefits and coverage for medial treatment.

📌 Can I challenge ICBC’s final decision of my claim?

A: Yes. If you are denied accident benefits you may challenge ICBC's decisions through BC’s Civil Resolution Tribunal (“CRT”), ICBC’s Claims Decision Review (“CDR”), or BC Small Claims (Provincial Court).

2024 Canadian Federal Budget: Changes to capital gains taxes unveiled.

Changes to Canadian Capital Gains Tax proposed in the 2024 federal budget are slated to come into effect on June 25, 2024, with a rise in the inclusion rate for capital gains from 50% to 66.67% for individuals realizing over $250,000 in annual capital gains, and all capital gains earned by corporations and trusts. Capital gains for individuals below the $250,000 threshold will remain subject to the current inclusion rate of 50%.

Although principal residences remain excluded from capital gains taxes, secondary properties such as investment units or non-primary residence cottages will be subject to the new inclusion rate upon disposition. However, the proposed changes also include an increase to the lifetime capital gains exemption and introduce an “Entrepreneur’s Incentive” for the disposition of qualifying shares.

As the deadline for filing income taxes in Canada draws near, it's essential to understand the process that the Canada Revenue Agency (“CRA”) uses for debt collection on outstanding tax obligations.

CRA is Canada’s most powerful creditor. It has powers under the Income Tax Act that permit broad and aggressive collection efforts against outstanding amounts owing to the CRA that have not been paid in a timely manner.

What do I do if I Receive a Notice of Collection (“Requirement to Pay Notice”)?

1. Don’t panic. It is extremely easy to stress yourself out, but it is also important to make rational and logical decisions.

2. Confirm that the tax liability being sought to be collected is accurate.

3. If the liability is accurate, contact your collection officer and work with them to pay the debt or establish a payment plan or delayed payment date. Be mindful that interest will continue to be incurred (currently 5% compounded daily) on the outstanding amount until paid in full. It is recommended to pay your debt in full right away, if at all possible.
