🌿 **Clean Air Day: The Right to Breathe Clean Air Matters** 🌿

On Clean Air Day, it's worth remembering that second-hand smoke doesn't stop at property lines. It drifts through neighbourhoods, parks, playgrounds, trails, transit stops, apartment complexes, and other shared spaces where families gather, children play, and people simply want to enjoy the outdoors.

British Columbia recognizes the importance of protecting people from exposure to to***co smoke. Under the To***co and Vapour Products Control Act and its regulations, smoking and va**ng are prohibited within 6 meters of doorways, open windows, and air intakes of public places and workplaces, including entrances to apartment and condominium buildings. The purpose of these rules is to prevent smoke from entering buildings and to protect people as they enter and exit.

Many municipalities have gone even further by restricting smoking in parks, playgrounds, sports fields, beaches, and other public spaces to reduce involuntary exposure to second-hand smoke.

The principle behind these laws is simple: everyone deserves the opportunity to enjoy public spaces and their homes without being forced to breathe someone else's smoke.

This Clean Air Day, let's support healthier neighbourhoods, cleaner parks, and public spaces where everyone—especially children, seniors, and those with respiratory conditions—can breathe a little easier.

If you’ve suffered a mental or physical injury because of someone else’s negligence, you shouldn’t have to navigate the aftermath alone. Injury—whether from assault, abuse, unsafe property conditions, medical negligence, or another preventable event—can affect every part of your life. You deserve support, clarity, and a path forward.

In British Columbia, personal‑injury law has changed significantly in recent years. While ICBC claims now fall under the Enhanced Care (no‑fault) system, many other situations still allow you to pursue compensation when another party’s negligence has caused you harm. These can include slip‑and‑fall injuries, medical malpractice, assault‑related injuries, occupiers’ liability, and other non‑vehicle‑related claims.

At Stevenson Luchies & Legh, we’re here to help you understand your rights, the options available to you, and what fair compensation may look like under BC law. Our goal is simple: to stand beside you with compassion, experience, and clear guidance so you can focus on healing while we focus on the legal steps.

If you or someone you care about has been injured, reach out. You don’t have to face this journey on your own.

Canada is a nation shaped by generations of people who arrived here seeking hope, opportunity, and a place to belong. Alongside the First Nations who have cared for these lands since time immemorial, we continue the shared work of building a country rooted in respect, understanding, and community.

Our cultural diversity can be one of Canada’s greatest strengths, a source of ideas, traditions, and perspectives. It will enrich our lives, as long as we emphasize what we share, what unites us, finding strength and fellowship in our common pursuit of a brighter future.

At Stevenson Luchies & Legh, we’re grateful to serve a community strengthened by its many voices and stories. Together, we build Canada—and together, we move forward.

The Law society is currently reviewing the decision released on April 29, 2026, in which Chief Justice Skolrood dismissed both claims from the Law Society and TLABC, stating that “I am not satisfied that the new regulatory structure is unconstitutional…"

It is our position that the Act fails to ensure the independence of the legal professions and their regulator, which is a fundamental democratic principle.

During the trial we initiated in October, 2025, the Law Society argued that independence from government is essential to the rule of law, the administration of justice and public confidence in B.C.’s legal system.

“This case was about protecting the ability of lawyers to serve their clients without government intrusion and ensuring that regulation of the profession remains focused on protecting the public interest in the administration of justice. This decision does not change that position,” says Law Society President Thomas L. Spraggs. KC.

The Law Society remains deeply concerned about the Act and we are reviewing the decision to consider next steps, including a possible appeal, as well as how the decision may impact the public and the legal profession.

At Stevenson, Luchies & Legh, we regularly see the hidden risks that can impact homeowners across British Columbia — and buried oil tanks remain one of the most overlooked.

If your home was built between the 1940s and 1970s, there’s a real possibility an old heating oil tank was left underground when the property transitioned to gas or electric. Unfortunately, out of sight does not mean out of risk.

Over time, these tanks corrode. When leaks occur, they can contaminate surrounding soil and groundwater — often resulting in significant remediation costs and complications during real estate transactions.

From a legal and liability standpoint, key concerns include:
• Tanks that were never properly removed or documented
• Potential denial of insurance coverage
• Liability that may extend beyond the current owner

What makes this issue particularly challenging is that there are often no obvious warning signs. In some cases, the only clue may be a small pipe — or nothing visible at all.

Whether you are buying, selling, or currently own property in BC, due diligence is critical. One simple question can make a significant difference:
👉 “Has there ever been an oil tank on this property?”

Addressing this early can help mitigate financial exposure and avoid complex legal and environmental consequences down the line.
