Don’t get caught up in misinformation about the divorce process!

Protect yourself when going through a divorce or separation by building the foundation of what you need to know.

Build your foundation with the correct information.

REMEMBER THAT THE FOLLOWING IS NOT TRUE!

✨ Moms Always Get Primary Parenting of Kids.
✨ You must hire a pitbull for a lawyer to fight for you.
✨ The courts will be on your side if your spouse cheated on you.
✨ The courts are against men.
✨ The most aggressive divorce lawyers are the best ones.
✨ “She” will get everything.
✨ You don't need to waste any money on a lawyer. Just reach an agreement with your ex and find a sample separation agreement online and fill it out.
✨ You should stay together for the sake of the kids. Separating is selfish.
✨ When a kid turns 12 they get to decide which parent they want to live with.
✨ If you “lawyer up” you will end up in court and spend a ton of money on legal fees.

I am regularly amazed that so many people have done little or no preparation when initially consulting with me. Initial preparation saves you and your lawyer oodles of time, thus significantly reducing the amount of your investment in legal fees. Regardless of whether or not you retain a lawyer, foundational preparation is the key to having you gain clarity for your path forward.

Preparation is key.

📔 Prepare a list of your assets.

Having no knowledge regarding your circumstances or the ability to access resources can make you profoundly vulnerable. Doing a little background work to understand and protect your finances is important.

✅ Open your own bank account and have your pay cheque deposited to that account.
✅ Get your own credit card
✅ Establish and Protect your own credit score
✅ Once you reach an agreement with your ex, close all joint accounts, lines of credit, and credit cards.

People often ask me, What are the effects of divorce on children? Here's the answer: The effect of divorce on your children will likely be positive if you co-parent peacefully with the other parent and terrible if you don’t

After the initial separation phase, which is almost always bumpy for a bit, kids settle down into their new routine and life. However, when parents are at war, regardless of whether that war happens in front of the children, kids feel it and know it; your kids are being hurt by it. Research shows that ongoing conflict damages children's bodies and the development of their brains.

You want to do everything possible not to kaobosh any toxicity in your co-parenting relationship.

The Effect of Divorce on Your Children will be tremendously negative if you place them in the middle of parenting disputes. The tragic part is that his parents are so busy blaming each other, that they refuse to see how their ongoing conflict is hurting their children.

Can you divorce without a lawyer? Of course you can!

Divorcing without a lawyer is up to you. However, there are four occasions when I highly recommend that you consult with a lawyer in your specific jurisdiction.

I highly recommend that you consult with a lawyer in your specific jurisdiction for at least an hour or two so that they can tell you what your rights and responsibilities are as it relates to what is most important, getting you to a final and legally binding separation agreement.

Did you decide to divorce without a lawyer? No problem! However, for the love of Pete! Make sure that if you have reached an agreement with your spouse, you get a lawyer to draft the separation agreement. Do not cheap out here. Do not simply download a free template for a separation agreement from the internet.

Why not just pull an agreement off the internet and fill it out? Because it will save you time, money and a lot of grief in the end. Spend a couple or a few thousand dollars to have the agreement drafted by a lawyer specializing in divorce.

Your first appointment with a divorce lawyer should be one of your first actions. Because you are getting divorced, you will need to know what the law says in your specific jurisdiction.

For your first appointment with a divorce lawyer, make sure you have ready (and they should have gotten you to fill out a form containing this information in advance) and on hand (or have emailed), basic information such as:

✨ Your address, occupation, annual income, and date of birth,
✨ Your spouse's full name, address, occupation, annual income, and date of birth,
the date each of you began living in your province, state or country,
✨ Your citizenships,
the date the two of you started to live together in a spousal-like relationship;
✨ If you're married, the date of your marriage and the name of the city or town where you got married,
the date of your separation, if you're separated,
✨ If you are separated but live in the same house still, let them know that too
✨ The full names and birthdates of your kids, if any
✨ Whether you and your spouse have signed any prenuptial or other agreements.

Not all divorce lawyers are the same, but when choosing your divorce lawyer, you want to make sure they are organized, that the intake process is smooth, and that when you are sitting with them the first time, they get right to it, advising you on all matters important to your unique circumstances.
