Kornfeld partner Carol Kerfoot has extensive experience in a broad range of business and real estate transactions, including acquisitions and divestitures, business start-ups and non-institutional financing.
Her understanding of financial information helps her deliver results-focused legal expertise to clients across a variety of sectors. Today, in our Word of Advice series, Carol shares a valuable suggestion on embracing a collaborative approach to solving problems.
She advises clients to tell their lawyers why they want a certain outcome, rather than simply instructing them on what they want done. “And then let your lawyer figure out how to accomplish it,” she says.
To lawyers, especially new ones, Carol suggests that they never shy away from asking their client questions. Even a straightforward query like, “Why do you think it needs to be done this way?” can open up a conversation that evolves a better solution for the client than they originally had in mind.
Carol says, "The most valuable advice we provide as lawyers is not the ex*****on, but identifying the most optimal process to achieve the desired outcome."
"In the case at hand, the Tribunal said while asthma could constitute a physical disability, which is a protected characteristic under the Code, the Complainant did not allege facts that would show that they actually experienced adverse impact," writes Shafik Bhalloo.
